DETAILED REQUIREMENTS OF THE ORDERING PARTY regarding the delivery 1. The ordering party reserves the right to use the option right (option right - 100% of the basic order) within the scope not exceeding the assortment and quantity contained in the annex, to the contract column “SCOPE OF THE OPTION RIGHT”. 2. The final quantity of food purchased under the option right will depend on the current needs of the ordering party and the financial resources available to it. 3. Food purchased under the option right must meet all the requirements as for the guaranteed order. 4. The ordering party reserves that the part of the order specified as “option right” is an entitlement, and not an obligation of the ordering party. The ordering party may not exercise the option right, in particular in the event of not obtaining financial resources for this purpose, and the contractor has no claims in this respect which the contractor accepts by signing this contract. 5. The ordering party guarantees to place orders within the framework of the basic order for the delivery of goods at a level not lower than 30% of the gross value of the contract, as mentioned in § 4 item 4 of the contract template constituting Annex no. 3 to SWZ. The implementation of the contract in the remaining scope will depend on the actual needs of the recipients resulting from the variable number of entitled to food and financial resources allocated for this purpose. The total scope of the option right has
