Germany – Pharmaceutical products – Abschluss nicht-exklusiver Rabattvereinbarungen nach § 130a Abs. 8 SGB V zu den Wirkstoffen Etanercept (ATC L04AB01) und Epoetin alfa/zeta (ATC B03XA01)

Section 130a paragraph 8 or Section 130c paragraph 8 of the SGB V enables health insurance funds (KK) and pharmaceutical companies to conclude framework rebate agreements for medicines to be dispensed at the expense of the statutory KK. The GWQ acts as the Society for Economy and Quality at KK according to Section 130a paragraph 8 sentence 5 SGB V for its shareholder and customer funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the GWB is carried out by the GWQ ServicePlus AG. The GWQ assumes that this procedure does not fall within the scope of cartel procurement law due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. The GWQ ServicePlus AG intends to lead, on behalf of the health insurance funds of the ARGE-OH-Bio Tech, to conclude non-exclusive rebate agreements according to Section 130a paragraph 8 SGB V with a contract start date of 01.01.2027. The following health insurance funds are members of the ARGE-OH-BioTech: - DAK-Gesundheit - Techniker Krankenkasse - Kaufmännische Krankenkasse - HEK - Hanseatische Krankenkasse - hkk - Handelskrankenkasse - GWQ ServicePlus AG (authorized for the health insurance funds listed in Annex 3).
