A sectoral dialogue and market survey have revealed that currently, and for the next few years, there is no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the contracting authority in accordance with the objectives of the Gigabit Framework Regulation 2.0. The contracting authority has therefore applied for funding for a comprehensive gigabit rollout in the viability gap model within the framework of the "Guideline for the Promotion of the Support for the Gigabit Rollout of Telecommunications Networks in the Federal Republic of Germany - Federal Gigabit Guideline 2.0 (Gigabit-RL 2.0)" of 31 March 2023, as amended on 30 April 2024 ("Gigabit-RL 2.0"), and received the notice of the final amount of the grant. The funds provided in this funding programme in the viability gap model (hereinafter: funds) are to be passed on by contracting authorities to telecommunications undertakings in the sense of EU state aid law as investment cost subsidies for the construction and operation of gigabit networks. The same applies to the co-financing according to the guideline of the Free State of Bavaria by the State of Bavaria.
