Poland – Miscellaneous computer equipment – Zakup sprzętu komputerowego wraz z oprogramowaniem na potrzeby Starostwa Powiatowego w Krakowie
Description
1) The subject of the contract is the supply and implementation of computer equipment with software for the needs of the District Office in Krakow. The purchase is necessary to maintain the continuity of the District Office's information system. 2) The contractor is obliged to deliver a new subject of the contract, not showing signs of use, produced with consideration of current technologies, free from any physical or legal defects and compliant with the requirements specified in the detailed description of the subject of the contract. 3) The detailed description of the subject of the contract and the conditions for implementation are contained in: a) the draft contract terms - Annex No. 8 to the SWZ, b) the description of the subject of the contract - Annex No. 7 to the SWZ. 4) The contractor is obliged to submit, together with the offer, the completed Annex No. 1A to the SWZ – Price Form. This Annex is an integral part of the offer and shall not be supplemented. In the Price Form, the data uniquely identifying the product and its price shall be provided precisely for each position. 5) The contracting authority requires the contractor to provide a quality warranty for the delivered subject of the contract for the periods specified in the description of the subject of the contract - Annex No. 7 to the SWZ, from the date of the final protocol acceptance of the subject of the contract. 6) The contracting authority requires that the offered service, including all ICT products, ICT services and ICT processes used to implement the contract, both as main elements and components, environment elements, service provisions or accompanying solutions, does not include: • ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; • an ICT product, the type of which has been determined in a decision on recognising the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement results in the rejection of the offer pursuant to Article 226(1)(17) or (19) of the Pzp Act. In order to verify the above circumstances, the contractor submits the appropriate declaration in the offer form, and the contractor is also obliged to submit Annex No. 1A to the SWZ – "Price Form", constituting the offer. In this form, the contractor enters data enabling the contracting authority to uniquely identify the offered assortment and ICT products, ICT services or ICT processes covered by the offer or used to implement the contract. The contracting authority informs that in this procedure it will apply the so-called reverse procedure. Based on Article 139(1) of the Act, the contracting authority will first conduct an examination and evaluation of offers, and then qualify the contractor whose offer was highest evaluated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 7) In matters not regulated by the Terms of the Contract, the provisions of the Pzp Act together with the implementing regulations and the provisions of the Civil Code of 23 April 1964 shall apply. 8) The contracting authority does not require the submission of a declaration, referred to in Article 125(1) of the Act (JEDZ), together with the offer by all contractors seeking to be awarded the contract. The contracting authority, in connection with the provisions of Article 139(1) and (2) of the Pzp Act, in order to confirm the lack of grounds for exclusion, will call the contractor whose offer was highest evaluated to submit a declaration, referred to in Article 125(1) of the Act (JEDZ).
