Poland – Repair and maintenance services of cooler groups – „Usługa polegająca na wykonaniu przeglądów, konserwacji, serwisowania i napraw urządzeń instalacji wentylacji mechanicznej i klimatyzacji w budynkach administrowanych przez 41.Bazę Lotnictwa Szkolnego w Dęblinie, Nr 26/26/N”

The procedure has been divided into 3 independent tasks.

1.1. TASK I - the subject of the contract are services consisting of: inspections, maintenance, servicing and repair of mechanical ventilation and air conditioning installation devices in buildings 428, 439 and in the airport warehouse MPS in the Dęblin – Airport complex, administered by the 41st Training Air Base in Dęblin, which is the property of the Polish State Treasury.

1.2. TASK II - the subject of the contract are services consisting of: inspections, maintenance, servicing and repair of mechanical ventilation and air conditioning installation devices: - in the Dęblin – Airport complex in buildings no.: 6, 7, 12, 109, 115, 183, 199, 226, 229, 236, 243, 244, 267, 299, 405, 409, 424, 426, 427, 434, 435, 436, 437, 438, 451, 452, 456, 458, - in the Klikawa complex in building no.: 9, social and sanitary containers, - in the Stawy complex in buildings no.: 1, 2, 20, 22, 96, 97, 98, - in the Dęblin – Twierdza complex in buildings no.: 18, 19, 36, 111, sanitary and residential containers, - in the WCR Puławy complex in building no.: 1, - inspection and servicing of air drying devices in the Dęblin – Airport complex, administered by the 41st Training Air Base in Dęblin, which is the property of the Polish State Treasury.

1.3. TASK III - the subject of the contract are services consisting of: inspection, maintenance, servicing and repair of devices, installations and systems located in buildings no. 48, 49, 66, 72 in the military complex Bezwola, administered by the 41st Training Air Base in Dęblin, which is the property of the Polish State Treasury.

2. REVERSE PROCEDURE: The contracting authority intends to use the so-called reverse procedure, as referred to in Article 139(1) of the Pzp Act, i.e. the contracting authority will first carry out an examination and evaluation of the offers, and then carry out a subjective qualification of the Contractor, whose offer was the highest rated, in terms of lack of grounds for exclusion and meeting the conditions for participation in the procedure. Before awarding the contract, the Contractor, whose offer will be the highest rated in a given task, will be invited to submit, within the specified deadline, current declarations and documents confirming the circumstances referred to in Article 57 of the Pzp Act, within the scope resulting from the content of the SWZ and the notice of the contract. Each contractor is obligated to submit with the offer a declaration, as referred to in Article 125(1) of the Pzp Act (JEDZ), because the contracting authority has not provided for the possibility of requesting this declaration exclusively from the contractor whose offer was the highest rated.

3. The contracting authority informs that in accordance with Article 16a of the Pzp Act (Dz.U.2026.793 t.j.): in the scope covered by the Agreement on Government Procurement of the World Trade Organization or other international agreements guaranteeing, on the principle of reciprocity and equality, access to the public procurement market, of which the European Union is a party, the contracting authority ensures contractors from third countries which are parties to this agreement or these international agreements, as well as construction works, supplies and services from these countries, the same treatment as contractors from the Member States of the European Union and construction works, supplies and services from the Member States of the European Union. The contracting authority informs that contractors, subcontractors, who come from so-called third countries, i.e. countries not covered by international agreements guaranteeing access to the public procurement market on the principle of reciprocity, are not admitted to participate in the procedure.

4. In accordance with Article 16b of the Pzp Act (Dz.U.2026.793 t.j.) contractors who carry out business activities and have their registered office or place of residence in countries other than the Member States of the European Union and other than the countries which are parties to the Agreement on Government Procurement (GPA – Government Procurement Agreement) concluded within the World Trade Organization (WTO – World Trade Organization), free trade agreements (FTA – Free Trade Agreements) concluded by the European Union (EU), economic partnership agreements (EPA – Economic Partnership Agreements), other international agreements, which provide for mutual access to public procurement markets, cannot apply for a public contract. Contractors together with contractors from third countries not being parties to international agreements, contractors cannot entrust the execution of part of the contract to subcontractors from third countries not being parties to international agreements.

5. Additional information: a) The contracting authority does not provide for: • conclusion of a framework agreement (Article 134(2)(7) of the Pzp Act); • selection of the most advantageous offer with the use of electronic auction (Article 134(2)(12) of the Pzp Act); • reimbursement of the costs of participation in the procedure (Article 134(2)(13) of the Pzp Act); • settlements in foreign currencies (Article 134(2)(10) of the Pzp Act); • possibility of providing additional services to the current contractor, as referred to in Article 214(1)(7) of the Pzp Act (Article 134(2)(8) of the Pzp Act); • requirement in terms of employment of persons, as referred to in Article 96(2)(2) of the Pzp Act (Article 134(2)(15) of the Pzp Act); • obligation to conduct a site visit (Article 131 of the Pzp Act). b) The contracting authority does not allow: • submission of variant offers (Article 134(2)(6) of the Pzp Act); submission of offers in the form of electronic catalogues or attachment of electronic catalogues to the offer (Article 134(2)(18) of the Pzp Act). c) The contracting authority does not reserve: • obligation of personal performance by the Contractor of the key parts of the contract (Article 134(2)(17) of the Pzp Act);
