Description
The subject of the contract is “Strengthening the flood protection potential of the Municipality of Szczyrk by purchasing a heavy rescue-fire truck with equipment”. 2. Under the contract, the Contractor will be obliged to deliver and commission a new, factory-built heavy rescue-fire truck with 4x4 drive, as detailed in Annex No. 8 to the SWZ – Description of the Subject of the Contract (OPZ). 3. Equivalence clause: 1) The Purchaser, in accordance with the provisions of Article 99(5) and Article 101(4) of the Pzp Act, allows equivalent solutions for supplies, works, materials, systems that meet the requirements specified in the contract documents. The Purchaser reserves the right that wherever in the content of Annex No. 8 to the SWZ – Descriptions of the Subject of the Contract, which is a description of the subject of the contract, trademarks, patents or origin of devices or materials are indicated in the description of this subject, they should be treated exclusively as proposals. The Purchaser allows methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject of the contract. Therefore, it is possible to propose in the offer all equivalent market counterparts with properties not worse than those indicated by the Purchaser. The parameters indicated in the contract documents define the minimum technical, operational, user, quality and functional conditions that the subject of the contract must meet. In the offer, methods, materials, devices, systems, technologies can be accepted, but with technical, quality and user and functional properties. At the request of the Purchaser, the Contractor has the obligation to prove that the solutions used will achieve all the technical assumptions for the subject of the investment task, taking into account the entire investment, and not a selected fragment of the whole. The burden of proof that a material or device is equivalent to the requirement specified by the Purchaser lies with the Contractor. If the materials and/or devices offered by the Contractor as equivalent are not equivalent in the light of the documents submitted by the Contractor, the offer of this Contractor will be rejected as not complying with the content of the SWZ. In the case of describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Purchaser allows the contract to be executed using equivalent solutions described. In such a case, the procedure described in the earlier part of this point is applied accordingly; 2) in the case of technologies, systems, materials or devices equivalent to those accepted by the Contractor for pricing, the offer must be accompanied by a list of these technologies, systems, devices or materials, which will contain in its content: the type and description of the technology or system used, the names of the device/material used, the name of the manufacturer, the precise and unambiguous type of device or material; 3) furthermore, for equivalent technologies/systems/devices/materials, the Purchaser requires documentation of equivalence, including calculations, detailed technical drawings, certificates, approvals, declarations of compliance with regulations and standards, and catalog cards of the manufacturers of equivalent devices/materials. These documents must unambiguously state the equivalence of the proposed technologies/systems/devices/materials; 4) in case of doubts about the equivalence of the equivalents of technologies/systems/devices/materials proposed in the offer, the Purchaser at the stage of examining the offer may require proof (documentation) of equivalence. In particular, for this purpose, it may request the Contractor to present catalogs of the manufacturer of the given technology/system/device/material equivalent. In particular, equivalent technologies/systems/devices/materials will be assessed in terms of the possibility of achieving the level of functionality, operating costs and reliability of operation specified for the technologies/systems/devices/materials.
