Hungary – Repair and maintenance services – Karbantartási feladatok DBR keretében (2026.)
Description
The Contracting Authority (CA or Contracting Authority) in this invitation to participate establishes a dynamic procurement system (DPS or Dynamic Procurement System) in accordance with Sections 106-107 of the Public Procurement Act. The name of the DPS is: „Maintenance tasks for Budapest Gyógyfürdői Zrt. within the DPS framework” The CA, referring to Section 107 (2) of the Public Procurement Act, records that the detailed technical description, quantity, and the full set of contractual terms (contract draft) for the specific public procurements to be implemented in the DPS will only be sent to the economic operators connected to the DPS with the individual invitation to tender, together with the procurement documents. The CA draws attention to Sections 46 (3)-(5) of Government Decree 321/2015. (X. 30.). According to these, any standard, technical approval, technical specification, or technical recommendation defined in the technical description sent together with the individual invitations to tender, along with the expression „or equivalent“, must be understood. Therefore, the CA accepts equivalent offers if the equivalence is substantiated in the offer according to Sections 46 (3)-(5) of the Government Decree. The basic information related to the DPS is as follows: Based on the DPS, maintenance tasks, diagnostics, and in the case of malfunctions identified or unexpectedly occurring during maintenance and fault rectification tasks, repairs, renovations, necessary equipment replacement, system expansions, and other related tasks can be carried out for the equipment, tools, and systems of the specified types and purposes related to the real estates (sites) owned, managed, or used by the CA (especially those indicated in the „Place of Performance“ section). The tools, systems, and the tasks and types of work referred to in the individual categories will be included in the technical content of the individual tendering phases with content corresponding to the needs of the Contracting Authority and in the necessary composition. The total estimated maximum net value of the contracts to be concluded during the DPS period (procurements to be implemented) is: net 190,000,000,- Ft. According to the „Guideline on the Dynamic Procurement System operated within the framework of the Public Procurement Authority“ (Guideline) point 4: „While both the Directive and the Public Procurement Act emphasize that DPSs can be divided into categories, these categories do not appear in the (EU) 2015/1986 Implementing Regulation on the annulment of the (EU) 2019/1780 Implementing Regulation, nor in the 44/2015. (XI. 2.) MvM Decree on the rules for the submission, review, and publication of public procurement and planning tenders, the templates for tenders, and certain content elements, as well as the annual statistical summary. Accordingly, the EKR does not recognize categories. If the contracting authority wishes to define categories in the invitation to participate in the establishment of the DPS, it can do so by creating technical sections in the notice, through which it informs the tenderers that these are not sections according to Sections 61 (4)-(6) of the Public Procurement Act, but categories according to Section 106 (4) of the Public Procurement Act.” With regard to the above, the Contracting Authority records that in this invitation, reference to sections in every case means reference to a category. No sections are defined when establishing the DPS, particularly with regard to defining categories and the last sentence of Section 106 (4) of the Public Procurement Act. In this regard, the Contracting Authority also wishes to refer to point 4 of the Guideline: „In the invitation to participate in the establishment of the DPS – unlike the invitation procedure according to Sections 82-84 of the Public Procurement Act – the specific procurement needs of the contracting authority are not yet included, so there is nothing that can be divided into sub-tendering lots. What can be foreseen at this point from the contracting authority's procurement needs is not divided into sub-tendering lots, but into categories. Later, within the framework of the already established DPS, the contracting authority will have the opportunity to enable tendering for sections.” The Contracting Authority divides the DPS into the following categories, in relation to which tendering phases can be initiated for tendering: 1. Pumps 2. Electrical equipment 3. Mechanical equipment 4. Cleaning and maintenance equipment 5. Windows and shading technology 6. Luggage lockers 7. Wave generators 8. Clock networks 9. Sauna technology equipment 10. Water slides 11. Medical devices 12. Fire and smoke protection equipment Information on expected procurements: The task involves performing work related to the maintenance and repair of the listed systems and equipment and possible system expansions, taking into account that the facilities are operating guest units and often historic buildings. The expected maximum size of the individual contracts to be awarded: net 36,000,000,- Ft. The expected content and characteristics of the tasks according to the individual categories, the expected maximum size of the individual contracts to be awarded, and the expected tasks already known for the individual categories (technical sections) will be presented in the information for the individual categories. Due to character limitations, the continuation is in the „Submission of Complaints“ section.
