The procedure is conducted to establish a Dynamic Purchasing System (DPS). Contractors, within the specified deadline, submit applications for admission to the DPS. The subject of the successive contracts awarded under the DPS will be deliveries of office software packages, operating systems, standard, cloud, and specialized software, forensic criminalistics software, software subscriptions, and their updates. The Contracting Authority estimates that it will annually purchase: approx. 1000 units of office software packages, 100 units of operating systems, 50 units of other software (including standard, cloud, specialized, forensic criminalistics software, software subscriptions) and a total of approx. 90 units of updates to the above-mentioned software. The Contracting Authority plans to award 4-5 contracts in a given calendar year during the validity of the dynamic purchasing system. The awarding of contracts will depend on the needs of the Contracting Authority and the financial resources available. The Contracting Authority will carry out the qualification of Contractors who have submitted applications for admission to the DPS, in accordance with the deadlines and rules resulting from Article 320 of the Pzp. After the first qualification of Contractors and the establishment of the DPS, Contractors not covered by the DPS will have the opportunity to submit an application for admission to the DPS for the entire period of its validity. After the opening of applications in the originally specified deadline, no further deadlines for submitting applications for admission to the DPS will be set. Contractors may submit applications for admission to the DPS even after the expiry of the originally specified deadline. The Contracting Authority ensures that Contractors not covered by the DPS have the opportunity to submit applications and qualify for the DPS, in accordance with Article 319 of the Pzp. The Contracting Authority will qualify Contractors on the basis of applications for admission to the DPS, which will be submitted during the validity of the DPS, in a similar manner, in accordance with the deadlines and rules resulting from Article 320 of the Act. If, before submitting an application for admission to the DPS during its validity, an invitation to tender for a contract covered by the DPS has been sent, the Contractor submitting such an application, after a positive qualification, will be invited to submit a tender only in the next contract covered by the DPS. The Contracting Authority may, throughout the validity of the DPS, call upon Contractors qualified to participate in the DPS to submit a new or updated EJED declaration, in accordance with the regulation specified in Article 322 of the Act. In the event that, in the new or updated EJED declaration submitted in response to the above call, the Contractor does not confirm that it is not subject to exclusion and meets the conditions for participation in the procedure, it will be informed, with the reservation of Article 126 of the Act, of its removal from the DPS. Contracts covered by the DPS will be awarded after conducting a procedure for awarding a specified contract in terms of quantity and subject matter covered by the DPS, in accordance with the rules specified in Article 323 of the Pzp, i.e.: The Contracting Authority invites all Contractors qualified for the DPS to submit tenders for each contract covered by the DPS, within a deadline of not less than 10 days from the date of transmission of the Invitation to Tender; The Contracting Authority selects the most advantageous tender based on the criteria for evaluating tenders specified in the Invitation to Tender. The Contracting Authority plans to evaluate tenders using the criterion of PRICE – 100%; During the examination and evaluation of tenders, the Contracting Authority may request Contractors to provide explanations regarding the content of the submitted tenders. The Contracting Authority will correct errors in the tender in accordance with the provisions of the Pzp; The Contracting Authority will not require tenders to be submitted in the form of electronic catalogues or to attach electronic catalogues to the tender. The specific conditions of the contract will always be determined separately for each individual contract awarded under the DPS. The result of such a contract will be the conclusion of an agreement with the selected Contractor. Together with the invitation, the Contracting Authority will provide the Contractors with a tender form. The Form should include the gross price of the tender, which must specify the total valuation of the subject of the contract. The tender price must include all remuneration elements due to the Contractor resulting from the preparation, implementation and settlement of the subject of the contract, including all direct and indirect costs that the Contractor will incur for the proper and timely implementation of the entire subject of the contract, profit, and all taxes and fees required by law, including delivery costs. The price must also take into account the risk of increased costs of implementing the subject of the contract. The price is the final price, not subject to negotiation and exhausting all claims of the Contractor against the Contracting Authority related to the implementation of the subject of the contract. The price of the tender is the gross value of the assortment constituting the subject of the contract price per unit net x quantity = net value + VAT = gross value, i.e. the price of the tender. The basis for calculating the price will be the description of the subject of the contract (attached to the invitation to tender) and the projected provisions of the agreement (annex to this document). The price should be stated in Polish zlotys in digital form, rounded to two decimal places. The Contracting Authority does not plan to raise objections in the procedure.
