The subject of the procurement is: Reconstruction of the Main Library and Institute of History building of the University of Opole. 1. The description of the subject of the procurement is set out in Annex 1A to the SWZ (file folder). 2.1 The contracting authority allows a site visit of the library building to familiarise with the location of the subject of the procurement. 2.2 This site visit is not mandatory and the provisions of Article 226(1)(18) of the Act shall not apply. 2.3 Detailed information on the site visit is set out in Section I, point 3.2.7 of the SWZ. II. Additional information 1. The contracting authority does not allow the submission of partial tenders. 2. The contracting authority does not allow the submission of alternative tenders. 3. Pursuant to Article 95 of the Act, the contracting authority requires the Contractor or Subcontractor to employ, under an employment contract (within the meaning of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2025, item 277 as amended)), persons performing the activities listed below related to the implementation of the contract, the performance of which consists in performing work. The type of activities related to the implementation of the contract, which are subject to the requirement of employment under an employment contract by the Contractor or Subcontractor of persons performing activities during the implementation of the contract: general building works. The method of verification by the contracting authority of the employment of these persons and the contracting authority's entitlement to control the Contractor's compliance with the requirements related to the employment of these persons and the penalties for failure to meet these requirements have been determined by the contracting authority in the draft contract constituting Annex 3 to the SWZ. 4. The contracting authority does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(7) and (8) of the Pzp Act. 5. Requirements regarding the security of proper performance of the contract 5.1. The contracting authority will require the contractor to provide security for the proper performance of the contract in the amount of 5% of the total price offered, which will be used to cover claims arising from the non-performance or improper performance of the contract. 5.2. The contractor will propose the form of providing security: in cash, bank guarantees or cooperative savings and credit bank guarantees, with the obligation of the bank being always a monetary obligation, bank guarantees, insurance guarantees, guarantees given by entities, as referred to in Article 6b(5)(2) of the Act of 9 November 2000 on the Establishment of the Polish Agency for Enterprise Development. Guarantees must be unconditional. 5.3. The security may be provided in one or more forms. 5.4. Seventy [70] percent of the security will be returned within 30 days from the date of completion of the contract and its acceptance by the contracting authority as properly performed, and thirty [30] percent will be returned 15 days after the expiry of the warranty period for defects or warranty. 5.5. The security must be provided no later than on the date of conclusion of the contract. (further information on security is set out in point 21 of the SWZ).
