Description

This is a defence and security contract. -----------------------------------------------------------

The contract comprises a single lot. It is a composite framework agreement including: - A lump sum part, including a firm tranche and optional tranches; - A part with purchase orders. It is a single-source framework agreement. Internal identifier: 2026.99.0002 The procedure is accelerated: no. Main characteristics of the procedure: The present framework agreement is subject to the negotiated procedure. A candidate who makes a false declaration may be sanctioned under Article 441-1 of the Penal Code for forgery and use of forgery. The present contract notice concerns only the tendering phase. The DCE will be accessible on PLACE (https://www.marches-publics.gouv.fr ) for candidates who will be admitted to submit a tender. --------------------------------------------------------

METHODS OF SUBMISSION OF TENDERS: Tenders must not be deposited at the functional address listed in section 8.1. They must be submitted on PLACE (https://www.marches-publics.gouv.fr ) following the instructions of the document "Methods of Submission of Tenders" available on https://armement.defense.gouv.fr/achats-darmement/documentation-et-referentiels-pour-les-achats/modalites-de-transmission-des-plis. The present consultation is accessible on PLACE via the following reference: DGA-CIRCEA-RCD-2026990002) In case of difficulties in accessing this file, information can be obtained at the address listed in section 8.1. A backup copy can be sent to the address listed in section 8.1 for postal deliveries or to the following address for deliveries by courier or bearer: 66 rue de la Porte d'Issy 75015 PARIS France. The envelope containing the backup copy will indicate the subject and the procedure number. Attention, for each stage of the procedure (tendering stage and tender stage), candidates and tenderers apply the same mode of transmission to all the documents they submit to the buyer. It is reminded that each candidate is responsible for the means of delivery of his tender. No tender deposited (in case of electronic transmission) or received (in case of postal reception for the sole backup tender) or handed in (in case of delivery by courier or bearer for the sole backup tender) after the deadline and time limit mentioned in section 5.1.12 will be considered. --------------------------------------------------------

CONSORTIUM: Consortium form: the form of the consortium is not imposed. Candidates must specify whether they are applying individually or as a consortium. If the candidate is applying as a joint consortium, the lead contractor will be jointly and severally liable, for the execution of the framework agreement, with each of the members of the consortium for their contractual obligations to the buyer. Candidates are prohibited from submitting several tenders for the framework agreement by acting at the same time: 1. as individual candidates and as members of one or more consortia; 2. as members of several consortia. Type of modification allowed: The composition of the consortia may not be modified between the tendering and the submission of the tender. Without prejudice to the above provisions, the provisions of Articles R2142-23 and R2342-14 of the CCP apply. --------------------------------------------------------

DOCUMENTS TO BE PROVIDED: The provision of all the elements/documents listed in sections 5.1.9 is mandatory. The absence of any of these elements/documents is sanctioned by the rejection of the candidate's or consortium's application. The documents submitted in support of applications in a language other than French must be accompanied by a translation into French. Only the French version is authentic. --------------------------------------------------------

OPERATORS FROM THIRD COUNTRIES TO THE EU OR EEA: In accordance with Article R 2342-7 of the Public Procurement Code, the present procedure is not open to economic operators from third countries to the European Union or the European Economic Area. The procedure remains open to subcontractors (subcontractors or subcontractors not having a subcontracting character) from third countries. --------------------------------------------------------

SIGNATURE OF DOCUMENTS: The documents contained in the tender file requiring a signature must be signed by a person authorised to commit the company (with indication of the name, first name, position of the signatory, and with the company's stamp). If the signatory of the documents does not appear in the public information via the SIREN number or the equivalent document for candidates established abroad, the candidate must provide any document attesting to the signatory's capacity to commit the company. --------------------------------------------------------

As regards electronic files, a signed .zip file does not constitute a signature of the documents it contains. Each document for which a signature is required must be signed electronically and separately by a person authorised to commit the company (cf. "Methods of Submission of Tenders" in section 2.1). --------------------------------------------------------

A scanned handwritten signature cannot replace the electronic signature. All members of the consortium must opt for the same signature format (electronic) without the possibility of mixing the two types of signature.
