Description

The subject of the procurement is Phase II of the upgrading and reconstruction of the public drainage system and the reconstruction of the water supply network in the Vodice-Tribunj-Srima agglomeration area, specifically in the town of Vodice and the settlements of Tribunj and Srima, all in Šibensko-Kninska County, Republic of Croatia. The works consist of the preparation of the Implementation Projects, records of the existing state, Projects of the existing state and accompanying documentation necessary for the implementation of the works and obtaining the necessary permits and construction. The scope of the works is defined by the Technical Specification and the Bill of Quantities. The works will be carried out under the Conditions of the Building Contract for Construction and Engineering Works designed by the Employer, issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999 in the Croatian translation issued by the Croatian Association of Consultants, the Croatian Chamber of Civil Engineers and the Association of Consulting Companies in Construction (so-called FIDIC Red Book), which are amended by the Special Conditions of the Contract given in the contract proposal. The "Conditions of the Building Contract for Construction and Engineering Works designed by the Employer", issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999, represent one of the most widespread codified general conditions for building contracts, which find their application worldwide. They represent a quality model of the contractual relationship between the Employer and the Contractor and, in cases of public procurement where the interest of bidders from other countries can be expected, ensure a higher degree of market competition and achievement of the purpose of public procurement ("best value for money"). Indeed, precisely because of their widespread application around the world, they represent a contractual model that is equally known to contractors from countries of the European Union as well as from other countries. Knowledge of local legislation governing building contracts would unjustifiably advantage contractors based in the country from which the Employer comes. The aforementioned represent the fundamental reasons why the Employer decided to procure the part of the procurement related to construction with the application of the aforementioned Conditions. In addition, the "Conditions of the Building Contract for Construction and Engineering Works designed by the Employer", issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999 systematically regulate the relationships between the parties in the construction, primarily the Employer, the Engineer and the Contractor, the allocation of risks, the manner of exercising rights from the contractual relationship, clearly define the deadlines within which certain actions must be taken, provide for ways of resolving disputed situations, regulate the manner of extending the implementation deadlines, additional payments and generally protect both the Employer and the Contractor in fulfilling their mutual obligations and exercising their rights. The application of the aforementioned Conditions additionally ensures that the contract will be fulfilled within the scope and deadlines determined and gives the Engineer, as the supervisory body, efficient mechanisms which he can use to achieve the aforementioned goals.
