The subject of this order is the purchase of medical equipment and accessories for medical devices. A detailed description of the subject of the order is specified in Annex No. 2 to the Order Specification. The subject of the order is free from physical and legal defects, factory new, not previously used by third parties, in particular, not used as a demonstration item, and is of good quality. It has also not been previously refurbished. The medical products offered as the subject of the order must meet the requirements specified in the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2024, item 1620). The labelling of the supplied materials, user instructions, and product descriptions must be prepared in the Polish language. The Contractor undertakes to execute the subject of the order in accordance with all the requirements of the Ordering Party as indicated in the SWZ. The Contractor is obliged to submit an offer for the entire given part or parts, selected by him, with all the positions of the given part taken into account. All the requirements specified in the order documents constitute minimum requirements, and their fulfillment is mandatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the order conditions pursuant to Article 226(1)(5) of the Pzp Act. If the Ordering Party, in the description of the subject of the order, indicates trademarks, patents, or origin, sources, or a specific process that characterizes the products or services supplied by a specific Contractor, equivalent solutions to those described are permitted, provided that they maintain the same minimum technical, quality, and functional parameters. In the event that the description of the subject of the order contains references to standards, technical assessments, technical specifications, and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp Act, the Ordering Party permits equivalent solutions to those described. The Contractor who refers to equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor attaches to the offer a list of equivalent solutions together with their description or standards.
