Poland – Food, beverages, tobacco and related products – „Sukcesywne dostawy produktów żywnościowych dla potrzeb WS – SP ZOZ w Zgorzelcu”

In accordance with SWZ: 3.1. The subject of the contract is the successive delivery of food products for the needs of WS – SP ZOZ in Zgorzelec. A detailed description of the subject of the contract is contained in the annexes no: 2 i.e. the price list, 3 to SWZ – i.e. Descriptions of the subject of the contract and annexes no 7 to SWZ – Contract templates. 2.1. The Purchaser allows the submission of partial offers. Number of lots – 10. Number of parts on which an offer can be submitted – 10. The Purchaser considers a partial offer to be an offer submitted for all items in a given Lot. The Contractor may submit an offer for all parts. 2.2. The Purchaser does not allow the submission of equivalent offers. 2.3. Each Contractor may submit only one offer. The submission of a greater number of offers or an offer containing variant proposals will be rejected. 2.4. The Purchaser does not allow the possibility of submitting variant offers (Article 92 of the Act). 2.5. The Purchaser does not envisage the conclusion of a framework agreement. 2.6. The Purchaser does not envisage the award of a contract, as referred to in Article 214(1)(7) and (8) of the Act. 2.7. The Purchaser does not envisage an electronic auction. 2.8. The Purchaser does not envisage or require a site visit or verification of the documents necessary for the implementation of the contract by the Contractor, as referred to in Article 131(2) of the PZP Act. 2.9. The Purchaser does not allow the possibility of settlement in foreign currencies. 2.10. The Purchaser requires the Contractor to indicate in the offer the parts of the contract, the execution of which the Contractor intends to entrust to subcontractors, and to provide the names of any potential subcontractors, if they are already known. 2.11. The Purchaser requires that, before starting the execution of the contract, the Contractor, if they are already known, shall provide the names and contact details of subcontractors and contact persons involved in the implementation of the contract. The Contractor shall inform the Purchaser of any changes in the above data during the implementation of the contract, and shall also provide information on new subcontractors to whom the Contractor intends to entrust the implementation of supplies/WITHIN THE SCOPE OF ACTIVITIES NOT SUBJECT TO CONCESSION. 2.12. If a change or resignation of a subcontractor concerns a party on whose resources the contractor relied, on the basis of Article 118(1), in order to demonstrate compliance with the conditions of participation in the procedure, the Contractor is obliged to prove to the Purchaser that the proposed other subcontractor or contractor independently meets them to the same extent as the subcontractor on whose resources the contractor relied during the procedure for the award of the contract. 2.13. The Purchaser does not envisage the possibility of granting advances on account of the execution of the contract. 2.14. The Purchaser does not envisage the reimbursement of the costs of participation in the procedure, except in the situation referred to in Article 261 of the Act. 2.15. The Purchaser does not allow the submission of offers in the form of electronic catalogues or the attachment of electronic catalogues to the offer, in the situation specified in Article 93 of the PZP Act. 2.16. The Purchaser reserves the right, in accordance with Article 139 of the Act, to first carry out an examination and evaluation of the offers, and then to carry out a subjective qualification of the Contractor whose offer was most highly evaluated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions of participation in the procedure. 2.17. The Purchaser requires the completion of part  in Section IV of the Standard Form of the European Single Procurement Document. 4. Contract performance period and method: 4.1. Contract duration: The contract will be concluded for a specified period of 12 months from the date of conclusion of the contract. 4.2. Payment term: 60 days from the date of a correctly issued VAT invoice to the Contractor's bank account appearing on the issued structured invoice. 5. Information on substantive evidence 5.1. In order to confirm that the subject of the contract offered meets the requirements specified by the Purchaser, Contractors are obliged to submit the following documents (documents should be submitted together with the offer): 5.1.1. The Purchaser does not require the submission of substantive evidence. 6. Conditions for participation in the procedure. Mandatory grounds for exclusion. 6.1.
