The subject of the contract are successive deliveries of a multi-assortment range for a period of 24 months in the kind and quantities given in the price form constituting Annex 2 to the SWZ and according to the planned provisions of the contract constituting Annex 4 to this SWZ, i.e. according to the tasks as follows:

Task 2: Delivery of reusable EKG electrodes, adhesive and limb (clamps) for EKG devices

Task 3: Delivery of EKG leads for Dräger Infinity M540 monitors

Task 4: Delivery of EKG leads for Comen C80 monitors

Task 6: Delivery of SpO2 sensors for cardiomonitors

Task 57: Deliveries of sensors and connectors for Drager Vista 120 cardiomonitor according to the detailed description of the subject of the contract contained in the Price Form constituting Annex 2 to the SWZ. The Contractor may submit an offer for one or more parts. During the examination and evaluation of offers, the Purchaser will consider each task separately.

2. In the event of no demand for the assortment covered by the subject of the contract, the Purchaser reserves the right not to order part of the assortment specified in the Price Form, constituting Annex 1 to the Contract, with the reservation of paragraph 3. The Contractor does not have any claims for compensation or claims based on any other legal basis, to which the Contractor agrees.

3. The Purchaser guarantees that the minimum value of orders awarded to the Contractor during the validity of the contract will be 50% of the remuneration of the Contractor for a given task, specified in the Price Form constituting Annex 1 to the contract. The Purchaser informs that in the subject proceedings conducted in the open tender procedure, it envisages the possibility of applying a procedure, as referred to in Article 139(1) of the p.z.p. Act. When applying the mentioned procedure, the Purchaser will first carry out an examination and evaluation of offers, and then carry out a subject qualification of the Contractor, whose offer was highest rated in terms of the absence of grounds for exclusion and meeting the conditions for participation in the proceedings.
