Description
With this tender notice, the contracting authority is awarding a framework agreement for the renovation of four (4) high-rise buildings in Brøndby Strand Parkerne. The tender is conducted as a competitive dialogue in accordance with §§ 67-72 of Act no. 1564 of 15 December 2015, as amended (the Public Procurement Act). The framework agreement covers the complete renovation of four high-rise buildings, including facade renovation with renovation of the high-rise buildings' facade system consisting of a climate screen with facade panels, window elements and subsequent insulation, as well as a steel structure to support the climate screen, internal renovation and energy optimisation, etc., carried out as a main contract. The high-rise buildings are located at Ulsøparken 1 (UL1), Hallingparken 1 (HP1), Hallingparken 2 (HP2) and Hallingparken 7 (HP7), 2660 Brøndby Strand, and are essentially identical in terms of appearance, construction and number of dwellings. A picture of one of the high-rise buildings is included in section 1.1 of the Descriptive Document. The complete renovation is carried out as part of the overall plan HP4. The framework agreement is awarded and entered into with one tenderer, see section 8.7 on tender evaluation in the Descriptive Document. The contracting authority places orders and enters into contracts under the framework agreement by direct award. The framework agreement and the individual contracts are based on AB 18 with the specifications set out in the framework agreement, see section 3.1 in the draft framework agreement. The contracting authority intends to use the framework agreement to carry out the complete renovation of all four high-rise buildings. The contracting authority intends to place orders under the framework agreement so that the renovation of all four high-rise buildings can be carried out in accordance with the contracting authority's overall schedule for the renovation of the high-rise buildings (Overall Schedule, see document and drawing list, see item 3.1 litra f) in the draft framework agreement), and as four (4) successive orders – Lot 1-4 – each covering one high-rise building at a time. It is intended that Lot 1 covers HP7, Lot 2 covers HP1, Lot 3 covers HP2 and Lot 4 covers UL1. The Overall Schedule is indicative and not binding for the contracting authority as stated in section 1.1 of the Descriptive Document. The contracting authority has chosen to structure the procurement of the overall renovation task for the four high-rise buildings as a framework agreement, as this – if the cooperation with the winning tenderer (the contractor) proceeds satisfactorily – provides the opportunity to optimise the renovation process from high-rise building to high-rise building by utilising the experiences that the contractor builds up during the previous lots on the framework agreement. It is also crucial for the contracting authority that the renovation of the four high-rise buildings is carried out in a satisfactory manner in terms of quality and time and in accordance with the framework agreement and the individual contracts. This is particularly important as the contracting authority, as a general housing organisation, has limited ability to handle cost increases without consequences for the rent level. By structuring the procurement of the overall renovation task for the four high-rise buildings as a framework agreement, the contracting authority obtains the opportunity to avoid further orders if the cooperation with the winning tenderer (the contractor) does not proceed satisfactorily, see sections 6-8 and section 27 in the draft framework agreement. The framework agreement has a duration of four years, see section 4 in the draft framework agreement. The scope and content of the framework agreement are described in the draft framework agreement with annexes. The contracting authority has, in accordance with the Public Procurement Act § 49, subsection 2, considered the division of the renovation task for the four high-rise buildings into sub-contracts. Due to the nature and complexity of the renovation project, including the significant need for coordination of interfaces between disciplines, the contracting authority has assessed that a main contract is most appropriate. A division into trade contracts and separate framework agreements would entail a significant risk of coordination challenges, delays and unclear allocation of responsibilities. The renovation project is therefore carried out as a main contract based on a single overall framework agreement. The framework agreement is tendered with a system supply, which includes the high-rise buildings' facades. The system supply includes both (1) the high-rise buildings' facade system consisting of a new complete climate screen with facade panels, window elements and subsequent insulation of the underlying facade, and (2) the high-rise buildings' steel structure, which constitutes a new supporting steel system to support the entire climate screen. Reference is made to the Work Description for the System Supply of the high-rise buildings' facades, see document and drawing list, see item 3.1 litra f) in the draft framework agreement, for a more detailed description of the system supply. The facade works constitute a central and technically complex part of the overall works, as they involve the renovation of high-rise buildings in 16 storeys with an existing construction, which the new facade system must be integrated into and connected with. The tenderers' choice of technical and construction-related solutions within the areas offered as a system supply has a direct influence on the execution process, execution rate and coordination. These aspects can therefore not be precisely determined in advance to such an extent that the tender can be carried out as an open or restricted tender without dialogue with the tenderers. The tenderers, with their market knowledge and technical expertise, have a significantly better basis than the contracting authority for identifying and projecting suitable solutions. Competitive dialogue is therefore necessary to determine and optimise the conditions relating to the execution process, execution rate and coordination, which depend on the tenderers' system choice. The tender is therefore conducted as a competitive dialogue in accordance with the Public Procurement Act § 67, subsection 1, litra a and b. The dialogue is conducted to clarify and specify conditions relating to the execution process, execution rate and connection technique, which follow from the tenderers' system choice within the framework of the specified functional requirements.
