Description
The subject of the contract is the cleaning of the buildings and premises of the City Office of Bydgoszcz. The subject of the contract is described in the appendix to the specification of the contract conditions (hereinafter SWZ) entitled "Description of the subject of the contract". 2. The contracting authority envisages the awarding of contracts, as referred to in Article 214(1)(7) of the Public Procurement Law (uPzp). Any similar contracts will cover tasks related to the cleaning of the buildings and premises of the City Office of Bydgoszcz. The conclusion of the contract will be preceded by an appropriate invitation to negotiations and negotiations. 3. For interested contractors, the contracting authority allows a site visit on 20.10.2026 at 10:00. The meeting place is the Town Hall – entrance at ul. Jezuickiej 1 in Bydgoszcz – at the porter's lodge. Participation in the meeting is not mandatory. The contracting authority does not envisage the verification of the documents necessary for the implementation of the contract (Article 131(2) of the Public Procurement Law (uPzp)).
II. CERTIFICATES. The personal evidentiary means indicated in Chapter X may be replaced by a valid certificate of the contractor of public contracts, as referred to in Article 124(2) of the Public Procurement Law (uPzp), exclusively to the extent to which the certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure (if the conditions have been specified in the procedure) in the scope corresponding to the requirements specified in the SWZ. The certificate does not replace personal evidentiary means concerning the grounds for exclusion not covered by the certification, in particular Article 108(1)(6) of the Public Procurement Law (uPzp), Article 109(1)(6) of the Public Procurement Law (uPzp), Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving the protection of national security, as well as circumstances that have arisen in the course of this procedure. 1. The certificate replaces personal evidentiary means exclusively in the scope covered by the valid certification and indicated by the contractor in the declaration, as referred to in Article 125(1) of the Public Procurement Law (uPzp). If the certificate covers only part of the grounds for exclusion or part of the condition (if the conditions have been specified in the procedure) for participation in the procedure, or confirms the fulfilment of the condition at a lower level than required in the SWZ, the contractor submits personal evidentiary means in the remaining scope. 2. In the scope resulting from the valid certificate, the contracting authority does not require from the contractor other personal evidentiary means, with the reservation of Article 124(4) of the Public Procurement Law (uPzp) and Article 31(6) of the Act on the certification of contractors of public contracts. 3. Pursuant to Article 126(1) of the Public Procurement Law (uPzp), before selecting the most advantageous offer, the contracting authority will call upon the contractor whose offer has been most highly evaluated to submit, within a specified period, not shorter than 10 days from the date of the call, the current personal evidentiary means indicated in Chapter X, to the extent to which they have not been replaced by a valid certificate of the contractor of public contracts, with the following provisions: 1) If it results from the preliminary declaration, as referred to in Article 125(1) of the Public Procurement Law (uPzp), that the contractor will use the certificate, and the contractor has provided data on the certificate enabling the contracting authority to independently verify the certificate in the certification database, the contracting authority will not call upon the contractor to submit personal evidentiary means in the scope to which the circumstances required by the contracting authority result from that certificate, 2) If the certificate does not cover all the circumstances required by the contracting authority, the contracting authority will call upon the contractor to submit personal evidentiary means exclusively in the scope not covered by the certification 3) If the data provided by the contractor do not allow the certificate to be found or verified in the certification database, the contracting authority may call upon the contractor to submit, supplement, correct or explain those data on the basis of Article 128(1) or (4) of the Public Procurement Law (uPzp). If, despite the call, the contracting authority is not able to verify the certificate, the certificate will not be taken into account in the scope which cannot be verified. 4) If the data necessary to assess the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the contracting authority may require the contractor to make those data available or to express consent for their disclosure to the contracting authority by the certifying entity, on the basis of Article 31(6) of the Act on the certification of contractors of public contracts. 5) In the event that the contracting authority obtains information indicating that the contractor has misled the certifying entity, which could have had a significant impact on the granting of the certificate of contractors of public contracts, or that the contractor has ceased to meet the conditions for granting that certificate, (if the conditions have been specified in the procedure) the contracting authority, on the basis of Article 128a(1) of the Public Procurement Law (uPzp), will call upon the contractor to provide explanations within a specified period, not shorter than 5 days from the date of the call. If the contracting authority deems the contractor's explanations to be insufficient, it will apply Article 128a(2) of the Public Procurement Law (uPzp). 6) In the event of the suspension of the validity of the certificate of contractors of public contracts in the course of the procedure, the contracting authority, on the basis of Article 128a(3) of the Public Procurement Law (uPzp), will call upon the contractor to submit, within a specified period not shorter than 5 days from the date of the call, personal evidentiary means in the scope to which the submitted certificate was to confirm the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure for the purposes of this procedure (if the conditions have been specified in the procedure). The provisions of Article 128(2)–(5) of the Public Procurement Law (uPzp) shall apply accordingly. 7) In the event of the loss of validity of the certificate in whole or in part in the course of the procedure, the certificate will not be taken into account in the scope to which it has lost its validity. In such a case, the contracting authority will call upon the contractor to submit the appropriate personal evidentiary
