Description
The subject of the contract is the delivery of 40 brand-new illuminated advertising and information columns (hereinafter referred to as: advertising and information columns), used to conduct information, promotional and advertising activities in the form of poster exhibitions, along with their installation at the indicated locations in the public space of the city of Toruń and technical maintenance. The detailed description of the subject of the contract is Annex No. 3 to the SWZ. 2. The contracting authority has not divided the contract into parts, as the contract constitutes a functional whole and there is no justification for dividing it into parts. The contracting authority requires, inter alia, for aesthetic reasons, the delivery of advertising and information columns of the same type, which will be placed in the city of Toruń. 3. The advertising and information columns referred to in point 1 must meet the technical requirements specified in Annex No. 3 to the SWZ (description of the subject of the contract). 4. In the case of describing the subject of the contract by indicating trademarks, patents or origin, source or a special process that characterizes the products or services provided by a specific contractor, the contracting authority allows equivalent solutions to those described, taking into account the provisions of jn.: The contracting authority has made efforts to describe the subject of the contract in an unambiguous and exhaustive manner, using sufficiently precise and understandable terms, taking into account all the requirements and circumstances that may affect the preparation of the offer. However, wherever in the SWZ trademarks, patents or origin, source or a special process that characterizes the products or services provided by a specific contractor are indicated, this means that the contracting authority could not describe the subject of the contract in a sufficiently precise and understandable manner, and such an indication means the possibility of applying an equivalent solution or product, so as not to lead to the privileged or elimination of some contractors or products. The required features of equivalence specify in each case the boundary parameters and functional requirements indicated for a given element of the subject of the contract. 5. In the case of describing the subject of the contract using standards, technical assessments, technical specifications and technical reference systems, the contracting authority allows equivalent solutions to those described, taking into account the provisions of jn.: Wherever in the SWZ specific standards or regulations are invoked, which are to be met by materials and equipment, the provisions of the latest edition or corrected edition of the invoked standards and regulations will apply. In the case where the invoked standards and regulations are national or relate to a specific country or region, other appropriate standards may also be applied, which ensure a fundamentally equal or higher level of performance than the invoked standards or regulations, provided that they are previously verified and approved in writing by the contracting authority. 6. Whenever the description of the subject of the contract refers to standards, technical assessments, technical specifications, technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp Act, the contracting authority allows equivalent solutions, provided that the contractor proves in the offer, in particular by means of substantive evidence, as referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. The contracting authority considers a solution to be equivalent if it enables the effect intended in the description of the subject of the contract to be achieved by means of other technical solutions or parameters not worse than those required and described in the SWZ. 7. The contracting authority has provided for the granting of an advance payment to the selected contractor for the implementation of the contract. Detailed information regarding the advance payment is contained in the contract template constituting Annex No. 2 to the SWZ.
