The subject of this order is the provision of a service for reactivating a bed of active carbon form WG-12 used in the Water Treatment Station "Miedwie", consisting of regenerating the bed in filters: B, C, D, G, i.e. 4 units, in a total quantity of 720 m3. The last regeneration of coal in filters B, C, D, G was carried out in the III/IV quarter of 2022. Bed parameters: bed height: 2.65 m, bed surface area: 67.92 m2, bed volume: 180 m3. The coal after regeneration should be backfilled into filters B, C, D, G and meet the requirements of standard PN-90/C-97554 – Formed Active Carbon. 2. The scope of the order is detailed in Annex No. 2, which is a description of the subject of the order 4. Note! Pursuant to Article 139(1) of the Act, the contracting authority will first examine and evaluate the tenders, and then qualify the contractor whose tender is highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5. Note! Pursuant to Article 139(2) of the Act, the contractor is not obliged to submit with the tender a declaration, referred to in Article 125(1) of the Act (Single European Procurement Document, hereinafter also referred to as SEPD). The contracting authority will call on the contractor, whose tender is highest rated, to submit a declaration, referred to in Article 125(1) of the Act (SEPD), in accordance with Chapter VI, Section 2, Paragraph 1 of the SWZ. 6. Pursuant to Article 128(1) of the Act, if the contractor has not submitted a declaration, referred to in Article 125(1) of the Act, subject documents, other documents or declarations submitted in the procedure, or they are incomplete or contain errors, the contracting authority will call on the contractor to submit, correct or supplement them within a specified deadline, with the reservation of Article 128(1) points 1 and 2, and (3) of the Act. 7. If the Contractor has not submitted the subject documents or the submitted subject documents are incomplete, the Contracting Authority will call for their submission or supplementation within a specified deadline. The provisions of this point shall not apply if the subject document serves to confirm compliance with the characteristics or criteria specified in the description of the tender evaluation criteria or, despite the submission of the subject document, the tender is to be rejected or the grounds for invalidating the procedure occur. 8. Pursuant to Article 107(2) and (3) of the Act, if the Contractor has not submitted the subject documents, or the submitted subject documents are incomplete, the Contracting Authority will call for their submission or supplementation within a specified deadline. The Contracting Authority may request an explanation from the Contractors regarding the content of the subject documents. 9. Subject documents confirming the absence of grounds for exclusion from the procedure are submitted by each of the Contractors jointly applying for the award of the contract. 9. Foreign contractors: The contracting authority requires the submission of documents, as referred to in this SWZ, in accordance with § 4 of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on subject documents and other documents or declarations that the contracting authority may request from the contractor. 10. Instead of the appropriate subject documents, the contractor may submit a certificate confirming the award of certification of public procurement contractors, respectively, in the scope referred to in Article 3(2) points 1 or 2 of the Act of 5 August 2025 on the certification of public procurement contractors.
