1. The subject of the procedure and the contract is the execution and modernisation of permanent exhibitions at the Muzeum Górnośląskie in Bytom: - execution of the third part of the natural history exhibition "City" and modernisation of existing sectors, - execution of the permanent ethnographic exhibition, - execution of the permanent archaeological exhibition. 2. The contracting authority does not allow partial tenders to be submitted. The reason for not dividing the contract into parts is the close functional, organisational, technological and execution-related interconnection of all elements of the contract subject. The contract covers the execution and modernisation of permanent exhibitions in one museum building, within one investment project, with the necessity of maintaining the conceptual, aesthetic, technical and functional coherence of the entire exhibition. The individual exhibitions, although located on different floors of the building, must create a uniform exhibition standard, including, inter alia, arrangement, scenographic, multimedia, lighting, informational solutions and equipment elements. Dividing the contract into parts could result in significant difficulties in coordinating works carried out simultaneously in one object, especially in terms of the schedule, logistics of deliveries, assembly, commissioning of multimedia and lighting systems, and acceptance. The implementation of the contract by several independent contractors would increase the risk of organisational and technical collisions, dispersion of responsibility for the correct execution of individual exhibition elements, and would hinder the pursuit of claims under the warranty and retention titles in case of defects at the interface of the scopes implemented by different contractors. The contracting authority considered that for the correct, timely and proper implementation of the contract, it is necessary to entrust the entire work to one contractor, who will be responsible for comprehensive coordination, execution, assembly, integration, commissioning and the final functional and visual effect of the exhibitions. The lack of division of the contract into parts is therefore justified by the nature of the contract subject and the need to ensure the uniform responsibility of the contractor for the entire contract, while this decision is not aimed at limiting competition, but at ensuring the efficient implementation of the project and achieving a coherent, complete and fully functional final effect. 3. The description and scope of the contract subject are in the Detailed Description of the Contract Subject constituting Annex A to the SWZ, the annexes of which are the design documentation for each of the exhibitions.
