Section 130a, Paragraph 8 of the German Social Code, Book V (SGB V) enables health insurance funds and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the German Act Against Restraints of Competition (GWB) is carried out by DAK-Gesundheit. For medicines to be specified by the bidder in more detail in Annex 2 to the contract for the aforementioned active substance Ezetimib + Atorvastatin (exclusively pack size 90 units), ATC C10BA05, DAK-Gesundheit intends to conclude discount contracts for medicines with as many interested pharmaceutical companies as possible until the entry into force of new discount contracts for medicines. A discount contract in accordance with the approval model for the aforementioned active substance will come into force for the first time on 01.03.2026 and will end on 29.02.2028 (plus extension option 1x12 months). It will end automatically with the entry into force of the exclusive contract, regardless.
