Germany – Pharmaceutical products – Abschluss einer nicht-exklusiven Rabattvereinbarung nach § 130a Abs. 8 SGB V zum Wirkstoff Palonosetron (ausschl. Dafo. WKA), ATC A04AA05 f. d. Z. 01.08.2026 - 31.07.2028 (zzgl. V.-Option 1x12 Monate)

Section 130a(8) of the German Social Code Book V (SGB V) allows health insurance funds and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, the DAK-Gesundheit regularly conducts substance-related, formal tendering procedures in accordance with the regulations of Part 4 of the German Act Against Restraints of Competition (GWB). For medicines to be specified by the bidder in more detail in Annex 2 to the contract, for the aforementioned active substance Palonosetron (exclusively in the dosage form WKA), ATC A04AA05, the DAK-Gesundheit intends to conclude drug discount contracts with as many interested pharmaceutical companies as possible until the entry into force of new drug discount contracts. A discount contract under the licensing model for the aforementioned active substance will come into force for the first time on 01.08.2026 and will end on 31.07.2028 (plus extension option 1x12 months). It will automatically end, regardless of this, with the entry into force of the exclusive contract.
