The subject of the contract is the construction of a shelter and evacuation area for a hospital with a back-up facility allowing for the provision of health services, and during peacetime serving as an underground parking lot and storage back-up. The building will be located on plot no. 3107/34 in Łęczna, at ul. Krasnystawska 52. The scope of the contract also includes the construction of an underground connector serving as communication with the existing hospital building along with the reconstruction of its external wall. A detailed description of the subject of the contract is specified in annex no. 2 to the specification of contract conditions. In case of doubt as to the scope of the subject of the contract, all materials provided to the Contractors within the indicated annex are within the scope of the description of the subject of the contract. 3.2. The Contractor is obliged to provide a temporary parking lot for 300 parking spaces for the employees of the hospital. The parking lot must be located within 300 m from the main building of the hospital in Łęczna. The pedestrian route from the parking lot must not pass through the provincial road 820.

3.3. It is within the Contractor's scope to develop all the executive, assembly, workshop, technological and other documents necessary for the proper implementation of the subject of the contract, if required due to the nature of the works, project documentation, legal regulations, manufacturer's requirements, technical knowledge principles or the requirements of the Contracting Entity. The documents mentioned above require prior acceptance by the Contracting Entity or the Supervision Inspector, however, this acceptance does not exempt the Contractor from responsibility for their correctness, completeness and compliance with the project documentation and legal regulations.

3.4. In accordance with Article 101(4) of the Act, if the Contracting Entity has described the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Act, the Contracting Entity allows for equivalent solutions. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". An equivalent solution to the one described by the Contracting Entity will be considered a solution confirming the fulfilment of at least the parameters specified in the standard required by the Contracting Entity. A Contractor who refers to equivalent solutions to those described by the Contracting Entity in terms of standards is obliged to declare in the offer that the works offered by him meet the requirements specified by the Contracting Entity.

3.5. Local inspection - each Contractor is obliged to carry out a local inspection (under the penalty of rejection of the offer) in order to verify the conditions of the construction site, conditions related to the performance of works being the subject of the contract as well as in terms of costing by the Contractor. The Contracting Entity sets two dates for the local inspection 17.07.2026 at 12.00 and 23.07.2026 at 12.00. Meeting of interested Contractors in front of the hospital building. An interested Contractor is obliged to send by 16.07.2026 or 22.07.2026 to the e-mail address: [email protected] a list of persons (first name and surname) who will participate in the inspection. The Contracting Entity sets a new non-binding date for the local inspection in order to view the documents in paper version of the Post-Contract Documentation of the current hospital building on 06.08.2026 at 9.00, conference room, first floor (next to the hospital chapel). An interested Contractor is obliged to send by 05.08.2026 to the e-mail address: [email protected] a list of persons (first name and surname) who will participate in the inspection. The Contracting Entity will confirm the conduct of the local inspection by the Contractor by preparing a list of attendance or a protocol from the local inspection. During the local inspection, the Contracting Entity will not provide any explanations or answer questions, all questions should be directed to the Contracting Entity in accordance with Article 135 of the Pzp Act.

3.6. The Contracting Entity does not foresee the possibility of granting advances.

3.7. The Contracting Entity sets the minimum warranty and guarantee period for the subject of the contract at least 36 months, and at most 60 months, in accordance with the adopted criterion for evaluating offers. The duration of the warranty and guarantee will be counted from the protocol confirmation of the removal of defects found at the final acceptance, which starts the warranty and guarantee period.

3.8. The Contractor will issue guarantee documents specifying the detailed conditions of the quality guarantee - "Guarantee Card" according to the template, which is annex no. 1 to the contract.

3.9. The price of the offer is a lump sum price resulting from the Contractor's own calculation made on the basis of the documentation. The Contractor makes the lump sum price calculation based on his own assessment, experience and knowledge. The price of labour, materials and equipment must include all overhead costs.

3.10. The subject of the contract is not divided into parts, as for technical and organisational reasons, it forms an indivisible whole.
