Germany – Pharmaceutical products – Abschluss einer nicht-exklusiven Rabattvereinbarung nach § 130a Abs. 8 SGB V zum Wirkstoff Cefadroxil (ausschl. Dafo. TAB), ATC J01DB05 für die Zeit 01.09.2026 - 31.08.2028 (zzgl. V.-Option 1x12 Mon)

Section 130a, paragraph 8, of the German Social Code (SGB V) allows health insurance funds and pharmaceutical companies to conclude framework rebate contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, the DAK-Gesundheit regularly conducts substance-specific, formal tendering procedures in accordance with the rules of Part 4 of the German Competition Act (GWB).

For the pharmaceuticals to be specified by the bidder in Annex 2 to the contract, namely the aforementioned substance Cefadroxil (exclusively in the form of tablets), ATC code J01DB05, the DAK-Gesundheit intends to conclude pharmaceutical rebate contracts with as many interested pharmaceutical companies as possible until the entry into force of new pharmaceutical rebate contracts. A rebate contract under the authorisation model for the aforementioned substance will come into force for the first time on 01.09.2026 and will end on 31.08.2028 (plus an extension option of 1x12 months). It will automatically end, regardless of this, with the entry into force of the exclusive contract.
