The subject of the procurement is the conclusion of a framework agreement for the intermediary service of purchasing a Microsoft software license within the MPSA (Microsoft Products and Services Agreement) sales programs. 4.2 The detailed description of the subject of the procurement is in Annex 1 to SWZ and in the essential provisions of the contract Annex 5 to SWZ. 4.3 The procurer does not envisage the submission of variant and partial offers. 6. PROCUREMENT PERIOD 6.1 Procurement implementation period: from the date of conclusion of the agreement for a period of 36 months. 6.2 The implementation deadlines for individual executive orders (delivery of Microsoft software licenses/subscriptions), the subject of which is covered by the framework agreement, amount to a maximum of 5 working days from the date of sending the order by the procurer. This deadline is dependent on the offer of the Contractor and constitutes a criterion for evaluating offers in the procedure for concluding the framework agreement. 1. PROCURER: City of Łódź – City Office of Łódź ul. Piotrkowska 104 90-926 Łódź acting as an entity performing tasks of the Central Procurer in accordance with art. 44 para. 2 and art. 49 of the Public Procurement Law PROCEDURE LEADER: Public Procurement Department in the Department of Organization of the Office and Service of Residents of the City Office of Łódź, ul. ks. Ignacego Skorupki 21, 90-532 Łódź 16.7. In accordance with art. 257 of the Public Procurement Act, the procurer does not envisage the possibility of invalidating the substantive procedure if the public funds that the procurer intended to allocate for the financing of the whole or part of the order have not been granted to it. 39. INFORMATION CLAUSE UNDER ART. 13 AND 14 GDPR 39.1 In accordance with art. 13 para. 1 and 2 of the General Data Protection Regulation of 27 April 2016 (Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) we kindly inform you that: 39.2 The data controller is the President of the City of Łódź with its registered office in Łódź at ul. Piotrkowska 104, 90-926 Łódź, e-mail: [email protected]. 39.3 The controller has appointed a data protection inspector and a deputy data protection inspector, with whom you can contact via e-mail [email protected]. You can contact the data protection inspector and his deputy in all matters related to the processing of personal data by the City Office of Łódź and the exercise of rights related to data processing. 39.4 Providing personal data is a necessary condition for participating in the public procurement procedure. The general basis for processing data is art. 6 para. 1 lit. b, c and e and art. 10 of the General Regulation. 39.5 The specific purposes of data processing have been indicated in the following provisions. a) Act of 11 September 2019 – Public Procurement Law; b) Act of 23 April 1964 – Civil Code; c) Act of 27 August 2009 on public finances; d) Act of 29 September 1994 on accounting 39.6 Your data will be processed for the purpose of: a) conducting a public procurement procedure and selecting a contractor; b) concluding a contract; c) financial and accounting settlement; d) providing and updating information about contracts concluded in writing, documentary, electronic or other special form as a result of a resolved public procurement procedure in the Central Register of Contracts. 39.7 Personal data may be disclosed to other entities entitled to receive them on the basis of applicable legal provisions, i.e. on the basis of art. 18 and art. 74 of the Public Procurement Law, an expert with specialist knowledge in the event of his appointment, the Minister of Finance as the body maintaining and maintaining the teleinformatic system of the Central Register of Contracts and any interested person due to universal, public and free access to data collected in the Central Register of Contracts via the website, and also to data recipients in the meaning of the provisions on the protection of personal data, i.e. entities providing postal, courier, IT, banking, insurance services, persons and entities interested in the conducted proceedings, as well as entities using the Bulletin of Public Information, the Bulletin of Public Procurement, the Competitiveness Database. In the event that the value of the order is equal to or exceeds the EU thresholds, the data will be transferred to the Official Journal of the European Union. 39.8 Furthermore, in the event that the City Office of Łódź acts as an entity performing the tasks of the central procurer, the data of the selected contractor will be transferred to the relevant municipal organizational unit for which the procedure is conducted in order to conclude and settle the contract. 39.9 Personal data will not be transferred to third countries. 39.10 Personal data will be processed, including stored for a period of 4 years, counting from the first January of the year following the year in which the case was completed, and then, in accordance with the provisions of the Act of 14 July 1983 on the national archival resources and archives, for a period of 5 years, in accordance with category B5, in the case of documentation of the procedure and 10 years in connection with the concluded contract, in accordance with archival category B10, and in the event of a change in the archival category of documentation for a period in accordance with the changed archival category of documentation. In the case of orders financed from European Funds or other funds not coming from the EU budget, on the basis of separate provisions in this scope up to 25 years. 39.11 Personal data will be stored in the CRU for a period of 5 years, counting from the end of the year in which the contract with the administrator ceased to be binding. After the expiry of this period, the data will be deleted from the CRU.
