Netherlands – Sewer cleaning services – Raamovereenkomst Reiniging en Inspecteren Riolering

The municipality of Schouwen-Duiveland wishes to conclude a framework agreement with one contractor with a duration of two years with two extension options of one year for the execution of works within the scope of maintenance of the sewerage system in the municipality of Schouwen-Duiveland. The works concern: a. Drawing up sub-orders; b. Cleaning sewerage; c. Inspecting sewerage; d. Additional works. The estimated value of the contract (duration 4 years) is estimated by the Contracting Authority at € 800.000,-. No rights can be derived from this estimate. The Contracting Authority is obliged, on the basis of case law (judgment ECLI:EU:C:2018:1034), to include a maximum contract value. The maximum contract value over the entire duration including extension options of the framework agreement is set at € 1.600.000,- including price indexations, excluding VAT. Given the unpredictability of the future extent of the need for this service, a margin of twice the estimated amount is taken. If the maximum contract value of € 1.600.000,- including price indexations, excluding VAT, is reached within the contract duration of the Framework Agreement (maximum 4 years), the Framework Agreement with the contractor will end upon reaching the aforementioned maximum contract value and the Contracting Authority will in that case not award any further orders, whereby the Contractor cannot make a claim for compensation on any ground.
