Through this notice, a Dynamic Purchasing System (hereinafter referred to as DPS) is initiated, which will allow the procurement of spare parts and repair and maintenance services for Mercedes multifunctional machines of the Unimog type, Caterpillar bulldozer equipment and the cars and vans in the equipment of DRDP CLUJ for a period of 2 years, with the possibility of extension, in the event that the estimated value/funds allocated have not been fully utilised. AC intends to award individual contracts through the DPS according to the needs of DRDP CLUJ. The contracts to be awarded through the DPS may be concluded as follows: either a supply contract, or a services contract and/or a mixed contract, which combines the supply of products and services in a single contract, determined based on the main purpose of the contract. The award procedure will respect the rules of the restricted procedure, following a two-stage process: • Stage 1: Submission of participation requests and selection of candidates, by applying qualification and selection criteria, • Stage 2: Submission of offers in the DPS by candidates selected in the first stage. Given the open nature of the DPS, after the launch of the DPS and throughout its validity period, an economic operator may join at any time during the validity of the DPS if it meets the criteria mentioned in the notice. The DPS is grouped into 4 categories (lots) of products and services, detailed in the tender dossier. The estimated value is the maximum estimated value of 4,493,012.59 lei excluding VAT of all contracts envisaged for the total period of application of the DPS. •Lot 1 Mercedes Multifunctional Machines - Unimog U1200, U1400 - Estimated value of Lot No.1 = 717,842.57 lei excluding VAT. •Lot 2 Mercedes Multifunctional Machines - Unimog U423 - Estimated value of Lot No.2 = 1,067,897.18 lei excluding VAT. •Lot 3 Caterpillar Bulldozer Equipment - Estimated value of Lot No.3 = 720,119.63 lei excluding VAT. •Lot 4 Cars and Vans - Estimated value of Lot No.4 = 1,987,153.21 lei excluding VAT. The limits of the contract modification will be in accordance with Law 98/2016, and will respect the provisions set out in Article 221 of Law 98/2016. AC reserves the right to modify the contract in accordance with Article 221 of Law 98/2016, provided that these modifications do not fall under the provisions of Article 221(7) of Law 98/2016, i.e. do not represent a substantial modification. REQUEST FOR CLARIFICATIONS/RESPONSE TO REQUESTS FOR CLARIFICATION A. In accordance with the provisions of Article 160(1) of Law 98/2016, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information in relation to the DPS is 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 160(2) of Law 98/2016, AC establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline set for the submission of tenders. *Any request for clarification submitted after the date mentioned in point A) will put AC in a position where it cannot provide a response within the timeframe mentioned in point B) and consequently any request for clarification submitted within the timeframe mentioned will be considered late. REQUEST FOR CLARIFICATIONS/RESPONSE TO REQUESTS FOR CLARIFICATION -STAGE II The minimum period for receipt of tenders is at least 10 days from the date on which the invitation to participate in the tender procedure was sent. - The deadline by which any interested economic operators have the right to request clarifications or additional information relating to the content of the information in the Invitation to Participate is a maximum of 5 days before the deadline for submission of tenders. - The deadline by which AC will respond clearly and completely to all requests for clarification/additional information is a maximum of 3 days before the deadline set for the submission of tenders.
