Denmark – Construction work – Udbud med forhandling af hovedentreprisekontrakt om renovering af 15 boligblokke i Kolding
Description
Skovparken, Section 21, is a public housing division administered by the housing company AAB Kolding. AAB Kolding is administered by the public housing organisation Bovia. Skovparken Section 21 is AAB Kolding's largest housing division. The first dwellings were constructed in the period 1971 – 1973, and originally consisted of 432 apartments distributed in 21 – 3 storey residential blocks. As part of a major modernisation in 1995 – 1997, 24 new roof apartments were built, and some larger apartments were also divided, so the total number of apartments is now 551. The residents decided at a division meeting that a master plan for the division should be implemented. The project is tendered as a main contract with the following overall scope: • Façade and roof renovation as well as new balconies on 15 residential blocks • Demolition of internal balconies on all 15 residential blocks • New ventilation system for all apartments • New heating supply connected to existing risers, all apartments • Conversion, including accessibility, of a selection of the apartments • Refreshment and safety measures in the basements of the residential blocks • Demolition of 3 underground parking lots in the terrain • Demolition of 3 blocks • Infrastructure work, with green courtyards, new internal road routes, main supplies etc. • Common house The contracting authority refers to the complete tender documentation for a more detailed description of the task. Common house Specifically regarding the common house, the contracting authority notes that some drawings and descriptions in the document list will be sent out at the latest two weeks after the notification of pre-qualification. These are documents that will supplement and specify the tender material that has been made accessible upon publication of the tender. Applicants thus have the necessary basis for applying for participation in the tender with the published material. Development plan The public housing division Skovparken Section 21 is covered by a statutory development plan. The development plan means that Skovparken must reduce the number of public family dwellings in Skovparken by 2030. Several cases are pending in the courts as to whether the legislation on which the development plan is based is an expression of discrimination that conflicts with Denmark's international obligations. The Supreme Court will issue a judgment on this issue in Q4 2026. If the Supreme Court finds that there is discrimination, there may be state intervention that requires the contracting authority to stop certain works – concretely probably the demolition of the three residential blocks. If this is the case, the contracting authority will have to adapt the tender material in accordance with the legislator's and authorities' instructions. Elderly housing As one of several measures to meet the goals of the development plan, a number of existing family dwellings in the division will be closed. As a replacement for the closed family dwellings, new elderly dwellings must be established. It is, pursuant to the public housing act, as a starting point a requirement that the new elderly dwellings are established in a newly established, independent housing division. AAB Kolding expects to be granted an exemption to deviate from this requirement, so that the family dwellings and the new elderly dwellings can be handled under the existing division at AAB Kolding. But in the event that an exemption is not obtained, the main contract allows the division for the elderly dwellings that will then be established at AAB Kolding, to enter the tendered main contract for the elderly dwellings. The delivery process will thus continue to be carried out jointly and on the basis of the same registration list, and the main contractor will in practice not experience that the division between the family dwellings and the elderly dwellings has significance for the execution of the tendered task.
