Description
The subject of the contract is the comprehensive organisation of foreign travel for employees, students, doctoral students, non-employees performing tasks for the university, and the arrival of foreign guests of the University of Silesia - reservation, sale and delivery according to current needs of air, rail, bus and ferry tickets as well as passport visa services, on the terms and conditions set out in the Detailed Description of the Subject of the Contract, which is Annex 2 to the SWZ. 2) The Detailed Description of the Subject of the Contract is Annex 2 to the SWZ. 3) The contracting authority does not allow the possibility of submitting partial offers. The indivisibility of the contract is due to the specificity of the subject of the contract, which includes a comprehensive service - the overall organisation of foreign business trips for employees, doctoral students, students and guests of the University of Silesia, including: finding suitable connections, reservation, sale and delivery according to current needs, both air, rail, bus and ferry tickets as well as passport visa services. In particular, it also includes ensuring the implementation of the entire trip, in accordance with the local regulations of the destination countries and informing the travellers about them in a timely manner that enables obtaining the appropriate documents (including any fees, e.g. airport, taxes, insurance, visas, transit visas, mandatory vaccinations) and informing the traveller, in a timely manner that enables obtaining the appropriate documents, if the implementation of the trip requires the purchase of additional services, the execution of which the contractor is unable to implement (e.g. purchasing a place, additional insurance). Furthermore, international travel often includes route sections connecting the journey by different means of transport, e.g. by rail and air. Such comprehensive travel organisation can only be carried out by a single contractor operating in the relevant industry. 4) The contracting authority does not envisage the possibility of submitting variant offers. 5) The contracting authority does not envisage the award of contracts for similar services within the meaning of Article 214(1)(7) of the Public Procurement Law (Pzp). 6) Contract performance period: for a period of 24 months from the date of contract signature or until the allocated budget is exhausted, whichever occurs first. 7) Place of performance: University of Silesia in Katowice, ul. Bankowa 12, 40-007 Katowice; 8) Detailed conditions for contract performance and payment terms are set out in the contract template, which is Annex 3 to the SWZ. 9) The contracting authority does not envisage any additional requirements related to the performance of the contract concerning social, economic, environmental aspects, innovation, employment or the confidentiality of information provided to the contractor during the performance of the contract; 10) The contracting authority does not envisage a reserved clause within the meaning of Article 94 of the Pzp; 11) The contracting authority specifies requirements related to the performance of the contract in terms of employment by the Contractor or subcontractor on the basis of an employment contract of persons performing the tasks indicated by the contracting authority in the performance of the contract, the performance of which consists in performing work in the manner specified in Article 22(1) of the Labour Code of 26 June 1974 (i.e. Journal of Laws 2025 item 277): a) The contracting authority requires that tasks related to searching, reserving, selling tickets, telephone and email support for employees, students, doctoral students and foreign guests of the University of Silesia and visa services (this does not apply to the personal performance of tasks by the Contractor or subcontractor), be performed by persons employed by the Contractor (or subcontractor, if the Contractor entrusts the performance of part of the contract to a subcontractor) on the basis of an employment contract within the meaning of the Labour Code of 26 June 1974 (i.e. Journal of Laws 2025 item 277); b) the method of verifying the employment of these persons, the contracting authority's rights in terms of controlling the contractor's compliance with the requirements related to the employment of these persons and the penalties for non-compliance with the above requirements, have been described in detail in § 4 of the contract template, which is Annex 3 to the SWZ. 12) The contracting authority does not envisage an obligation for the personal performance of key tasks related to service contracts by individual contractors jointly applying for the award of the contract within the meaning of Article 60 of the Pzp, or related to the participation of entities providing resources within the meaning of Article 121 of the Pzp. 13) The contractor may entrust the performance of part of the contract to subcontractors. The contracting authority does not reserve the obligation for the contractor to personally perform key parts of the contract; the contractor should indicate in the offer which parts of the contract they intend to entrust to subcontractors and provide (if known) the names (companies) of these subcontractors. 14) The offer should be secured with a bid bond in the amount of: 20,000.00 PLN (in words: twenty thousand zloty and 00/100). 15) The contractor whose offer is considered the most advantageous will be obliged to provide, before the contract is signed, a guarantee of proper contract performance in the amount of 5% of the maximum nominal value of the contracting authority's obligation arising from the contract (The contract value is the amount of funds allocated by the contracting authority for the performance of the contract. The amount of funds available to the contracting authority will be provided to the contractors before the deadline for submitting offers.).
