Germany – Pharmaceutical products – Abschluss von nicht exklusiven Rabattverträgen gemäß § 130a Abs. 8 SGB V zu Arzneimitteln (Open-House-Verfahren)

The present procedure is not subject to public procurement law. It is an open-house procedure. In the interest of transparency and the widest possible information of interested pharmaceutical companies, this notice is published in the Supplement to the Official Journal of the European Union. To the extent that formulations are used in this notice which indicate the award of a public contract, this is solely due to the specifications of this notice form. Neither the use of this form nor the use of the medium "TED" implies submission to public procurement regulations, the applicability of which is not mandatory by law, public procurement regulations, or the case law of the European Court of Justice. The AOK Baden-Württemberg (AOK) intends to conclude non-exclusive discount contracts in accordance with Section 130a (8) SGB V with all suitable pharmaceutical companies for medicinal products with the active substances listed in Annex 3 to the terms and conditions as well as under Section 5.1 of this contract notice and under Section 5.1 of the follow-up notices. The contract period begins at the earliest on 1 July 2024, has a maximum duration of 30 months and ends at the latest on 31 December 2026 (with the exception of the following active substances/active substance combinations: Ustekinumab, end of contract period 31 December 2024; Beclometasone dipropionate + Formoterol hemifumarate-1-water + Glycopyrronium bromide, end of contract period 31 March 2025; Somatropin, end of contract period 30 June 2026; Indacaterol maleate + Glycopyrronium bromide, end of contract period 30 June 2026; Tacrolimus-1-water, end of contract period: 30 June 2026). A contract can be concluded at any time on a month's notice within the period from 1 July 2024 to 31 December 2026 (with the exception of the aforementioned active substances/active substance combinations).
