Description

I. The subject of this public procurement procedure is the purchase of a robotic surgery system along with equipment, ancillary devices, trainings, and warranty-maintenance services for the Wojewódzki Hospital im. Jana Pawła II in Bełchatów, in accordance with the detailed description of the required technical parameters of the medical equipment covered by the contract, which the Contractor is obligated to deliver, install, and commission, in accordance with the description of the subject of the contract, which constitutes Annex 2.1 to SWZ - Required Technical Parameters and Annex 2.2 to SWZ - TECHNICAL PARAMETERS SUBJECT TO EVALUATION IN THE OFFER ASSESSMENT CRITERION (if applicable). II. WARRANTY PERIOD: 60 months. The Contractor provides a quality warranty and guarantees against defects for a period of 60 months, counted from the date of signing the final acceptance protocol of the subject of the contract. The detailed conditions regarding the warranty and guarantee are specified in the Draft Contract Terms, constituting Annex 4 to SWZ. III. EQUIVALENCE - With regard to all the indicated and required norms, European technical assessments, approvals, technical specifications, and reference systems as well as certificates specified in the SWZ, the Contracting Authority allows equivalent solutions. The names and trademarks provided by the Contracting Authority are exemplary in nature, and their indication is intended to define the expected standard. The Contracting Authority allows the submission of equivalent offers. The Contracting Authority will consider a “equivalent product” to be a product with technical parameters no worse than those indicated in the description of the subject of the contract. The Contracting Authority reserves the right that wherever in the content of the SWZ documentation, constituting the description of the subject of the contract, trademarks, patents, or origin, sources, detailed processes, or technologies that characterize the products or services provided by a specific Contractor, norms, European technical assessments, approvals, technical specifications, and technical reference systems have been indicated - the Contracting Authority allows equivalent methods, materials, devices, systems, technologies, norms, specifications, etc., to those presented in the description of the subject of the contract. Therefore, it is allowed to propose in the offer all equivalent market counterparts with properties no worse than those indicated by the Contracting Authority. The parameters of the indicated standard define the minimum technical, operational, user, quality, and functional conditions that the subject of the contract must meet. The indicated trademarks, patents, brands, or producer or source names or specific processes, norms, European technical assessments, approvals, technical specifications, and technical reference systems indicating origin, only define the class of products, methods, materials, devices, systems, technologies, norms, European technical assessments, approvals, technical specifications, and technical reference systems, etc. In the offer, it is possible to accept methods, materials, devices, systems, technologies, etc., of other brands and producers, but with technical, quality, and user and functional properties corresponding to the methods, materials, devices, systems, technologies, norms, European technical assessments, approvals, technical specifications, and technical reference systems, etc., described in the SWZ. The Contracting Authority emphasizes that, in accordance with Article 101(5) of the Pzp Act, the burden of proof that the offered subject of the contract is equivalent in relation to the requirements specified by the Contracting Authority in the SWZ, lies with the Contractor submitting the offer. The general rules regarding equivalence have been specified in the Annex to the SWZ.
