Contract for the procurement of foodstuffs within a Dynamic Purchasing System (DPS) framework. The duration of the DPS (12 months) is the estimated total quantity to be ordered: 12 months: I. Meat Products II. Poultry III. Pork and Beef IV. Dry and Other Goods V. Frozen Goods VI. Pickles VII. Vegetables, Fruit VIII. Bakery Products IX. Dairy Products X. Eggs Annual Quantities for 12 months in total: 1 In the case of Meat Products: Delivery of meat products according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 3774 kg. 2 In the case of Poultry: Delivery of poultry according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 7320 kg. 3 In the case of Pork and Beef: Delivery of pork and beef according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 24820 kg. 4 In the case of Dry and Other Goods: Delivery of dry and other goods according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 31125.25 kg, 210 packages, 22683 items and 1012 l. 5 In the case of Frozen Goods: Delivery of frozen goods according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 16680 kg and 10230 items. 6 In the case of Pickles: Delivery of pickles according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 3150 kg. 7 In the case of Vegetables, Fruit: Delivery according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 46330 kg. 8 In the case of Bakery Products: Delivery of bakery products according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 11100 kg and 223700 items. 9 In the case of Dairy Products: Delivery of dairy products according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 1980 kg, 200 packages, 50800 items, 12550 litres, 1660 boxes. 10 In the case of Eggs: Delivery of eggs according to the minimum requirements specified in the technical product description, which is part of the procurement documents, in a total quantity of 30000 items. The specified quantity was determined based on previous usage experience, known as the experiential quantity, the procured quantity may deviate from these data. The subject of this procurement procedure is the delivery of the following foodstuffs within a Dynamic Purchasing System (DPS) framework for a period of 12 months, or until the framework budget is exhausted. The quantitative data detailed above, as well as in the procurement documents, are estimated and informative in nature. The Inviting Party reserves the right to deviate from the specified quantities during the contract period, exceeding the available framework budget by a maximum of 20%. The Inviting Party intends to conclude contracts valid for 6 months during the validity of the DPS, but reserves the right to extend the temporal validity of the contract by a further 1 month once, at least 30 days before its expiry, by means of a unilateral declaration, provided that the framework budget is not exhausted. The Inviting Party, pursuant to Section 107(2) of the Public Procurement Act, will provide the precise technical description and contractual terms for the specific public procurements to be implemented in the system simultaneously with the dispatch of the call(s) for tenders. The Inviting Party draws attention to the fact that, pursuant to Section 46(3) of Government Decree 321/2015 (X. 30.), references in the procurement documents to a specific branded or sourced item, or to a specific process, which characterises the products of a given economic operator or the services provided by them, or to a trademark, patent, activity, person, type or specific origin or manufacturing process, serve to clearly, precisely and understandably define the subject of the procurement. In every case, the expression "or equivalent" must also be understood alongside the reference. The equivalence must be proven by the tenderer in accordance with Chapter VII of Government Decree 321/2015 (X. 30.) and the provisions of the procurement documents. Tenderers may only submit tenders for products that fully comply with the specifications of the Inviting Party and meet the requirements set out in the Hungarian Food Codex. Tenderers must also take into account the information provided in the procurement documents regarding the products. The Inviting Party draws the attention of tenderers to the decision of the Public Procurement Review Board No. D.225/9/2009: "The Board's position is that in the case of a procurement requirement containing a specific technical requirement, it is not possible for tenderers to submit a so-called blank tender, i.e. not to specify which specific products they will fulfil. This requirement arises from the subject matter and nature of the procurement, as the subject of the present procedure is a purchase of goods."
