Description
The subject of the framework agreement concerns maintenance services for the Kelvin Hughes SBS 80051 coastal surveillance radar at DGA TN SESDA site. This is a defence or security contract subject to a negotiated procedure in accordance with the provisions of Articles L 2324-1, L 2324-3, R 2324-1, R 2324-3, R 2361-1, R 2361-8 to R 2361-12 of the Public Procurement Code (CCP). The present framework agreement is single-award. It is composite and includes a lump-sum portion, a portion with purchase orders in accordance with the provisions of Article R. 2362-8 of the CCP and a portion with subsequent contracts in accordance with Articles R. 2362-1 to R. 2362-7 of the CCP. The expected services include: Annual recurrent lump-sum services, the first year of which corresponds to the lump-sum portion: logistical support by on-site intervention for systematic preventive maintenance operations and to carry out occasional operations including expertise and corrective maintenance; Radar overhaul services; Computer console evolution service (porting of the current console or equivalent product); Supply of spare parts; Transferability/reversibility service at the end of the framework agreement; Other services within the framework of subsequent contracts: notably in case of "exceptional breakdown" for damage due to external unforeseeable elements or not attributable to the contractor. The subsequent contracts will specify the characteristics and the terms of execution of the services or supplies that have not been set out in the framework agreement. The site in question is that of DGA Techniques Navales de Saint-Mandrier. The deadline for submission of tenders is set for 22 June 2026 at 17:00 (Paris time). The deadline and time limit indicated in section 5.1.12 are in UTC format. The framework agreement is concluded for a validity period of 7 (SEVEN) years, with no minimum amount and a maximum amount of (€700,000.00 excl. VAT), indicated in section 2.1.3 below. This maximum amount corresponds to an overall estimate for the framework agreement project, without any commitment on the part of the State to reach it. The maximum amount indicated in sections 2 and 5 below is in euros excl. VAT. The duration of the framework agreement project indicated in section 5.1.3 is given purely as an indication. The tender documents will be sent later to the candidates admitted to tender and a site visit will be mandatory. The provisions of Article R 2394-1 of the CCP (review clause) may be applied to allow, under certain conditions, modifications having, in particular, the object of managing the updating of the references of parts (addition, removal). Candidates must indicate in their application whether they are applying as an individual candidate or as a group of economic operators. Candidates are prohibited from submitting, for the framework agreement, several offers by acting at the same time: 1. as individual candidates and as members of one or more groups; 2. as members of several groups. The form of the group is not imposed. However, if the candidate presents itself in the form of a joint group, the leader will be jointly and severally liable, for the execution of the contract, with each of the members of the group for its contractual obligations towards the buyer. Indeed, the availability of the radar is essential for the conduct of operational tests, which requires that the leader supplements its defaulting co-contractor so as not to compromise its conduct. The composition of the groups may be modified, and it is possible to form new ones between the submission of the applications and the submission of the initial offers if all the members of the new group, presented at the stage of the offers, have been authorized at the stage of the applications to submit an offer or to participate in it, at least as an accepted subcontractor in the application phase. The newly constituted group must meet the requirements relating to the capacities of the candidates. Furthermore, the provisions of Articles R 2142-3 and R 2342-14 of the CCP apply. In accordance with Article R 2342-7 of the Public Procurement Code, the present procedure is not open to economic operators from third countries to the European Union or to the European Economic Area.
