The subject of the contract is: "Whole-year (current and winter) maintenance of national roads under the administration of the General Directorate for National Roads and Motorways, Rzeszów Branch, divided into 4 parts: Part 1 – maintenance of national roads in the Przemyśl Region - motorway A-4 from Rzeszów East (without junction) to Jarosław West (with junction) Part 2 – maintenance of national roads G, GP in the Przemyśl Region Part 3 – maintenance of national roads G, GP in the Lesko Region Part 4 – maintenance of national roads G, GP and S in the Nisko Region." The Buyer allows the submission of partial offers in accordance with the division of the subject of the contract specified in point 6.1. IDW SWZ. Pursuant to Article 91(1) of the Pzp Act, the Buyer specifies that one Contractor may submit an offer for a maximum of two arbitrarily chosen parts of the contract. The subject of the contract includes the performance for Part 1 from 1 May 2027 to 30 April 2031, and if the contract is signed after 1 May 2027, it will be valid from the date of the protocol transfer of the roads to maintenance until 30 April 2031, for Part 2 from 1 September 2027 to 31 August 2031, and if the contract is signed after 1 September 2027, it will be valid from the date of the protocol transfer of the roads to maintenance until 31 August 2031, for Part 3 from 1 May 2027 to 30 April 2031, and if the contract is signed after 1 May 2027, it will be valid from the date of the protocol transfer of the roads to maintenance until 30 April 2031, for Part 4 from 1 June 2027 to 31 May 2031, and if the contract is signed after 1 May 2027, it will be valid from the date of the protocol transfer of the roads to maintenance until 31 May 2031, with the maximum total period of validity of the Contract, including the option right, as mentioned in Section 1(8), not exceeding 48 months from the start of the contract implementation, works of whole-year, including winter and current maintenance of roads, in particular: - maintenance of road surfaces and engineering structures - maintenance of verges and median strips, - maintenance of the road body, - maintenance of drainage, - maintenance of pavements and cycle paths, - maintenance of signage, - maintenance of traffic safety devices, - maintenance of the aesthetics of signs, traffic safety elements and the roadway, - maintenance of supporting devices, - winter maintenance of roads, - Contract Management, - maintenance of cleanliness and repair and maintenance works on engineering structures. The detailed scope of the subject of the contract required to be performed is specified in the Subject of the Contract Description, Technical Specifications, Draft Contract Provisions. The Buyer envisages the possibility of applying the option right, as mentioned in Article 441(1) of the Pzp Act. Within the framework of this contract, the Buyer envisages the possibility of applying the option right in the scope of: 1) Performance of works on road sections other than those indicated in Section 1(1), located in the Region, the roads of which are maintained within the framework of this Contract, or in the neighbouring Regions for it, entering the structure of GDDKiA, specified in Annex 15 to the Contract in the scope specified in Annex 2 to the Contract, Tables of Settlement Elements for works marked as works to be implemented within the framework of the option right. These works will be settled at the prices specified by the Contractor for the basic contract for these works. The prices for roads of the same cross-section and maintenance standard will be used to calculate the Contractor's remuneration; 2) the possibility of entrusting the Contractor with the performance of works, in the case mentioned in Section 3(2) - for a period not longer than 10 months - within the scope of the basic contract, at the prices specified by the Contractor for the basic contract in Annex 2 to the Contract, Tables of Settlement Elements, Collective Cost Summary, with the maximum total period of validity of the Contract, including the option right not exceeding 48 months. Other information regarding the option is contained in the further Volumes of SWZ. The value of the contract is above 140 000 EUR. The Buyer reserves the obligation of personal performance by the Contractor of the key tasks covered by the subject of the contract. The Contractor is obliged to personally perform the key tasks reserved by the Buyer, in accordance with Article 121 of the Pzp Act, specified in Group of Works 11 – Contract Management, i.e. activities performed by the following members of the Road Maintenance Team: - Road Maintenance Manager; - Deputy Road Maintenance Manager. With regard to the key task reserved for personal performance by the Contractor, the Contractor may not invoke the capabilities of the entity providing resources, on the basis of Article 118(1) of the Pzp Act, in order to demonstrate the fulfilment of the relevant participation conditions in the procedure.
