Supply of milk and dairy products divided into 3 parts. Part 1: Supply of milk and dairy products – Garrison Toruń Part 2: Supply of milk and dairy products – Garrison Inowrocław Part 3: Supply of milk and dairy products – Garrison Toruń, ul. Popiołowa Road. According to art. 57 of the Pzp Act, tenders may be submitted by Contractors who: 1.1.are not excluded; 1.2.meet the participation requirements: 1.2.1.ability to operate in the economic turnover - The Purchaser does not specify requirements in this regard, 1.2.2.entitlement to carry out a specified economic or professional activity, if this results from separate provisions; 1.2.2.1 The Contractor will meet the condition if they have been admitted to the production or trade in foodstuffs – Act of 25 August 2006 on food safety and nutrition and possess an up-to-date decision or certificate issued by the competent authority of official food control - if the law imposes such an obligation to possess such entitlements. 1.2.2.2 The Contractor will meet the condition if they have a registered economic activity in the field of production, storage, packaging and trade in agricultural foodstuffs, to the voivodeship inspector of the commercial quality of agricultural foodstuffs – Act of 21 December 2000 on the commercial quality of agricultural foodstuffs - (Dz. U. z 2023 r., poz. 1980) - if the laws impose an obligation to possess such entitlements. 1.2.3.economic or financial situation - The Purchaser does not specify requirements in this regard, 1.2.4.technical or professional capacity: The Contractor will meet the condition if they prove that within the last 3 years before the deadline for submitting offers, and if the period of carrying out the activity is shorter - in this period, they have carried out or are carrying out the supply of milk and dairy products, which is the subject of the contract, for one Recipient within one contract, in an uninterrupted period of at least 6 months, for individual parts: Part 1 - of a value not less than 200,000.00 PLN, Part 2 - of a value not less than 200,000.00 PLN, Part 3 - of a value not less than 200,000.00 PLN confirmed by evidence that it was (is being) properly carried out. If the Contractor submits an offer for more than one part of the subject procedure, they are obligated to prove the implementation / implementation of the above supplies to one recipient, within one contract for the highest of the amounts specified as a condition for participation in the procedure required for the parts for which the offer is submitted (list of supplies along with references). 2. The subject evidence means for parts: 1-3 have been described in detail in Section VI SWZ. In order to confirm that the offered supplies meet the requirements and characteristics specified by the Purchaser, the Purchaser requires the submission of the following subject evidence means with the offer: HACCP system certificate issued by companies possessing accreditation and authorisations of the Polish Centre for Accreditation with its seat in Warsaw or the national accreditation organisation for the given country or a certificate of the competent authority of the State Sanitary Inspection on the supervision of the application of the implemented HACCP system or a certificate of the competent authority of the State Veterinary Inspection on the supervision of the application of the implemented HACCP system, of the acquired goods. 3. The Contractors are obliged to submit the subject evidence means with the offer. 4. If the Contractor has not submitted the subject evidence means or the submitted subject evidence means are incomplete, the Purchaser will call for their submission or supplementation. 5. The Purchaser envisages changes to the contract and their detailed scope is contained in the draft provisions of the contract. 6. Tenders may be submitted by Contractors who are not excluded on the basis of exclusion grounds from art. 5k of the Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014), in its current wording and from art. 7(1) of the Act on special solutions in the field of counteracting support for aggression on Ukraine and serving to protect national security submitted on the basis of art. 125(1) of the Act of 11.09.2019 Public Procurement Law. 7. No current decision of the Military Veterinary Inspector may be issued to a Contractor applying for a contract, ordering the commanders of units and military institutions to cease procurement from the given Contractor. 8. The offer must contain the following documents and declarations: - Completed and signed with a qualified electronic signature: tender form (attachment no. 2) and assortment-price form prepared on the basis of the template constituting attachment no. 2.1-2.3. - Declaration of the Contractor of not being excluded from the procedure on the basis of art. 5k of Council Regulation (EU) 833/2014 in the wording given by Regulation 2022/576 (OJ EU No. L 111 of 8.4.2022, p. 1) together with the Declaration regarding the exclusion grounds on the basis of art. 7(1) of the Act on special solutions in the field of counteracting support for aggression on Ukraine. - Subject evidence means; - Power of attorney – if applicable; - Obligation of a third party – if applicable; - Declaration of Contractors jointly applying for the award of the contract – if applicable. - Document confirming the appointment by Contractors jointly applying for the award of the contract of a proxy – if applicable. - Declaration of Contractors on the provision of resources – if applicable. 9. Subject evidence means - indicated in Section IX SWZ.
