Execution of port infrastructure works provided for by the project “Modernisation of port platforms, modernisation of railway lines within Romcim, installation of CF weighing station, construction of a second level crossing with the railway, construction of a new CF connection from line 2 to 67, modernisation and extension of the rollerway of the loading dock towards the land” The contract duration is 78 months, of which 18 months is the execution period of the works, and a minimum of 60 months guarantee, for the works executed regarding line 67, and a minimum of 36 months, for the guarantee of works, other than those mentioned above, after their completion. We note that at present the project is approved by the Management Authority – AM PT, with the financing contract being signed. Accordingly, according to art. 21 para. (1) of H.G. nr. 395/2016, “The contracting authority may initiate the application of the award procedure only after the award documentation and supporting documents have been drawn up and approved”. The maximum period for which the suspensive clause operates is 12 months from the date of transmission of the communication regarding the result of the procedure, so that, in the event that the condition of signing the financing contract is not fulfilled, or the contracting authority does not identify other funds from which to ensure the financing of the investment, the award procedure will be automatically cancelled. The deadline by which any interested economic operator has the right to request clarifications or additional information regarding the award documentation is 20 days before the deadline for submission of tenders. The contracting authority will respond only once, to all requests for clarification, on the 11th day before the deadline for submission of tenders (see Art. 161, para. (1) of Law 98.2016).
