This notice is for the conclusion of agreements with pharmaceutical companies in accordance with Section 130a (8) sentence 1 of the German Social Code (SGB V). The invitation to participate is addressed solely to pharmaceutical entrepreneurs or associations of pharmaceutical entrepreneurs as defined in Section 4 (18) of the German Medicines Act. This is not an Open Procedure under Section 15 of the German Regulation on the Award of Public Contracts (VgV) in conjunction with Section 119 (3) of the German Act against Restraints of Competition (GWB), but a publication of the invitation to conclude/join discount contracts with conditions fixed and non-negotiable for all participants, including the level of the discount. There can be an unlimited number of contractual partners, which can be pharmaceutical entrepreneurs or associations of pharmaceutical entrepreneurs as defined in Section 4 (18) of the German Medicines Act.
