Description

4.1. The subject of the order is the purchase of equipment for OWIT as detailed in Annex 1 to the SWZ. 4.2. The subject of the order includes: a) The subject of the order also includes transport, installation, and commissioning. b) The subject of the order is detailed in Annex 1 to the SWZ – delivery specifications. c) The ordering party informs that all offered equipment, and associated software must be factory new. d) The delivered equipment, as well as software and accessories that are the subject of the order, must comply with applicable standards and have the required certificates, approvals, technical approvals, declarations of conformity of built-in materials, safety certificates, homologations, licenses, etc. e) The documents mentioned in point d) The Contractor is obliged to deliver to the Orderer in one copy no later than on the day the Contractor reports readiness for acceptance. f) The Contractor is not obliged to deliver with the offer technical sheets/catalogue sheets specifying the technical data and parameters of the offered equipment. The Contractor will submit these documents at the delivery stage together with the equipment. In the event of delivery of equipment that does not meet the requirements of the Orderer specified in Annex 1 to the SWZ – description of the subject of the order, the Orderer will consider that the equipment has not been delivered. g) The Orderer allows the submission of offers for equipment that is the subject of the order with equivalent or better parameters, in accordance with the Public Procurement Law. The Contractor who refers to solutions equivalent to those described by the Orderer is obliged to prove that the supplies offered by him meet the requirements specified by the Orderer. h) The equipment models, devices, software listed in Annex 1 (if any) are not mandatory for the Contractor, who may include in the valuation another model of equipment, device and software meeting the technical parameters and requirements specified by the Orderer. i) As part of the implementation of the subject of the order, the Contractor will: - deliver and install the delivered equipment in accordance with the provisions of the SWZ, the manufacturer's instructions and applicable regulations and standards, - commission the delivered equipment and install the appropriate software necessary for the correct operation of the subject of the order. If any equipment, device or other elements are damaged or become damaged during transport, installation they will be replaced with new ones or repaired by the contractor before reporting the completion of deliveries for acceptance, - conduct training on the operation of the equipment for the user's employees, where necessary. - all waste generated during the implementation of the order the Contractor is obliged to remove and dispose of at his own expense. All damages in the building caused during delivery and installation due to the fault of the Contractor will be removed by him free of charge or by the Orderer or the User at his expense. - The Orderer, by implementing the provisions of the grant agreement, obliges the contractors to take care of the natural environment, for example, by using materials that come from recycling or are subject to the recycling process, eliminating single-use items made of plastics, giving up the use of single-use packaging, bags, nets and promotional items made of polyolefin plastics, etc. - The Contractor will notify the Orderer 7 days in advance of the delivery and installation date of the equipment. - The Contractor is obliged to include in the offer price all the costs necessary for the proper implementation of the order. - The Orderer requires a minimum 12-month warranty for the entire subject of the order. NOTICE: The Orderer informs that the subject of delivery in part 1 in its entirety are medical products, therefore the appropriate VAT rate is 8% and this should be taken into account in the valuation. In part 2 - positions 4 and 5 are subject to an 8% VAT rate and this should be taken into account in the valuation. The remaining positions, i.e. 1, 2, 3, 6, 7, 8 and 9 are subject to a 23% VAT rate.
