The subject of the contract is the continuous supply of consumable materials, as well as the provision during the validity of the contract of the equipment necessary for the performance of anterior and posterior segment eye surgeries for the Foundation. The supply of this material must comply with all legal and technical requirements that allow its use for the correct treatment of patients attended by the Foundation. Based on the lots of the file, the awarders must provide the equipment specified in each of them, without this entailing any additional cost for the Foundation, with the obligation for the awarder to start up, maintain and update it during the validity of the contracts signed. Contracts with equipment provision mean that the maintenance will include the costs of labor and all materials, the replacement of parts, spares and other elements necessary to guarantee the correct functioning of the equipment during the validity of the contracts. This is a mixed contract of supplies and services. In accordance with Article 18 of Law 9/2017 LCSP, in relation to Article 34.2, the services are directly linked to each other and maintain relationships of complementarity that require consideration and treatment as a functional unit. The legal regime of the preparation and awarding of this contract will be determined in accordance with the provisions of Article 18 of the LCSP and, in view of the nature of the main service, the rules to be observed will be those of the supply contract. As for its effects, compliance and extinction, it will be determined in accordance with the provisions of Article 122.2 of the LCSP and, in view of the applicable rules to the different co-participating services, they will be those of the supply and service contract. The awarder undertakes to deliver a plurality of goods successively and at a unit price without the total amount being defined exactly at the time of signing the contract, as the deliveries are subject to the needs of the Foundation (art. 16.3 of the LCSP).
