Description

The subject of the contract is implemented as part of the project entitled „Construction of the Care and Treatment Facility in SPWZOZ in Stargard to improve access to long-term care in the Stargard County area” (project no. KPOD.07.08-IP.10-0180/24) co-financed from the resources of the National Reconstruction and Resilience Plan as part of investment D4.1.1. Development of long-term care through the modernization of the infrastructure of healthcare entities at the county level. The subject of the contract will be implemented in accordance with the requirements specified in the Appendices to the SWZ. A detailed description of the subject of the contract and the manner of its implementation is Appendix No. 1.1 to the SWZ - Detailed Price Offer with a breakdown into 10 packages and Appendices No. 7, 7.1 and 7.2 to the SWZ. Detailed provisions regarding the performance of obligations relating to this contract are contained in the draft contracts – Appendices No. 7, 7.1 and 7.2 to the SWZ. 1. The Contractor, in order to confirm compliance with the conditions of participation in the procedure and to demonstrate the lack of grounds for exclusion under Article 125 of the PZP Act, is obliged to submit, together with the offer, a declaration of non-exclusion and compliance with the conditions of participation in the procedure, in the scope indicated by the Contracting Authority: 1) The declaration of non-exclusion and compliance with the conditions of participation in the procedure is submitted on the Form of the Single European Standard Procurement Document, hereinafter referred to as the “SESD”, drawn up in accordance with the standard form specified in the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the Single European Standard Procurement Document (OJ L 3, 6.1.2016) in accordance with the form constituting Appendix No. 2 to the SWZ. 2) In order to confirm compliance with the technical or professional capacity condition, the Contractor is obliged to declare that in the last three years before the deadline for submitting offers, or if the period of conducting business is shorter – in this period – it has properly completed at least two deliveries (each delivery understood as one contract) corresponding in type and scope to the subject of the contract – Appendix No. 8 to the SWZ. The minimum gross values of each of the deliveries required by the Contracting Authority have been specified in the SWZ. 3) In the case of joint bidding by Contractors, each Contractor submits the SED. 4) In the case of relying on the capacities or situation of entities providing resources, the Contractor also submits the SED of the entity providing the resources together with the commitment of the entity providing the resources to make the necessary resources available to the Contractor for the implementation of the contract or another documentary evidence confirming that the Contractor, in implementing the contract, will have the necessary resources of these entities. 5) In the scope of Part IV of the SED, the Contractor may limit itself to completing section α and does not have to complete any of the other sections in Part IV. 2. Before selecting the most advantageous offer, the Contracting Authority will invite the Contractor whose offer was the highest rated to submit, within a specified deadline, not shorter than 10 days, current documentary evidence: 1) In order to confirm that the Contractor meets the conditions of participation in the procedure regarding the required authorizations to conduct a specified economic or professional activity, the Contractor, if required by the nature of the contract, will submit a document confirming the possession of the qualifications or authorizations to conduct a specified professional activity (in accordance with § 7(1) of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on documentary evidence and other documents or declarations that the Contracting Authority may require from the Contractor) - current permit, license, concession or entry in the register of regulated activity. 2) Information from the National Criminal Register prepared no earlier than 6 months before its submission, in the scope of: a) in accordance with Article 108(1)(1) and (2) of the PZP Act, regarding a final conviction for specified offences and b) in accordance with Article 108(1)(4) of the PZP Act, regarding a court order prohibiting participation in public procurement as a criminal penalty, 3) A declaration by the Contractor, in the scope of Article 108(1)(5) of the Act - the form of the declaration is Appendix No. 3 to the SWZ, 4) an extract or information from the National Court Register or from the Central Register and Information on Economic Activity, in the scope of Article 109(1)(4) of the Act, prepared no earlier than 3 months before its submission, if separate provisions require registration in the register or record. 5) a declaration by the Contractor on the currency of the information contained in the SED, in the scope of the grounds for exclusion from the procedure indicated by the Contracting Authority - the form of the declaration is Appendix No. 4 to the SWZ. As documentary evidence, the Contractor is obliged to submit, together with the offer, for each offered product (if a given product requires it): catalogues with a detailed description of the product, certificates or declarations of conformity, instructions (if a given product has such an instruction), technical descriptions and warranty cards; which documents will be in Polish, to confirm the conformity of the offered product with the description of the subject of the contract and compliance with the standards and requirements provided for by law for each specific assortment specified in Appendices No. 1.1 to the SWZ – Detailed Price Offer by individual packages. The Contracting Authority provides for the supplementation of documentary evidence in accordance with Article 107(2) of the PZP.
