The total advisory tender is conducted as a negotiated procurement in accordance with the Public Procurement Act §§ 61-66 with a prior pre-qualification. The tender is divided into two contracts, and bids can be submitted for either one or both contracts. The award criterion is "the best price-quality ratio" in accordance with the Public Procurement Act § 162, section 1, no. 3. The tender is conducted as a tender with two contracts/total advisory agreements, and bids can be submitted for either one or both contracts. Evaluation of applications and bids is conducted individually for both tasks and independently of each other. The two projects will, in the planning, tendering and execution phases, be carried out with a temporal offset as appears from the main schedules for the two projects attached as project document 2.05 and 2.06. The total advisor is budget responsible for each project. The enterprise budget for Alssund-Skolen is budgeted at approximately 91 million DKK excl. VAT and incl. unforeseen expenses, in total for the renovation and renovation of the school and outdoor areas. The enterprise budget for Gråsten Skole is budgeted at approximately 98 million DKK excl. VAT and incl. unforeseen expenses, in total for demolition, renovation, renovation and new construction of the school as well as establishment of outdoor areas. If an applicant wishes to be pre-qualified for both contracts, two separate pre-qualification applications must be submitted. It should be noted that the selection criteria for pre-qualification are different for the two schools, and therefore different advisory teams may be pre-qualified for the two contracts. If an applicant is pre-qualified for both schools and chooses to submit bids for both contracts, it should be noted that there are minor variations in the sub-criteria for the two bids. The client organisation will also have two different project managers – one for Alssund-Skolen and one for Gråsten Skole. Therefore, no overlap in meeting or process flow between the two projects can be expected. The total advisory tender is conducted after prior pre-qualification. Among the pre-qualification applicants, 4 teams for each project are selected to be invited to submit bids. The client, as part of the pre-qualification, has a desire to ensure the possibility of achieving a varied field of larger and smaller companies. The bidding phase begins with an inspection of Gråsten Skole and Alssund-Skolen respectively. The inspection takes place on the same day and in succession. It is emphasised that dialogue and discussions regarding the two projects should take place via the project web. If the client chooses to use the option for negotiation, bidders are invited to participate in one negotiation round, which is either conducted in writing or with individual negotiation meetings. After the negotiation round, the bidders further process their final bids based on the individual and joint feedback from the client, which is then evaluated by the client. The bidding phase concludes with the issuance of an evaluation and designation of winners for the two contracts. Sønderborg Municipality intends, after the standstill period has expired, to enter into total advisory contracts with the winning bidder for each contract, which best possible fulfils the award models for the bidding phase. The client reserves the right not to conduct a negotiation and thus award the contract based on the initial bid according to point IV.1.5 in the tender notice. The timetable in the tender is arranged so that no negotiation round is conducted, but that contracts are awarded based on the initial bids. Should a negotiation be conducted, the timetable will be shifted in parallel accordingly. The award criterion is "the best price-quality ratio" in accordance with the Public Procurement Act § 162, section 1, no. 3. Exclusion: An economic operator is excluded from participation if the economic operator is covered by one of the mandatory exclusion grounds in the Public Procurement Act § 135, section 1-3, § 136, section 1, no. 1-4 and § 134 a. Furthermore, an economic operator is excluded from participation if the economic operator is covered by the voluntary exclusion grounds in the Public Procurement Act § 137 section 1, no. 1-6. An economic operator cannot be excluded from participation if the economic operator presents sufficient documentation that the economic operator is reliable, even if the economic operator is covered by one or more of the exclusion grounds in the Public Procurement Act §§ 135-137, according to the Public Procurement Act § 138, section 1. Council Regulation (EU) 2022/576. Contracts cannot be awarded to the following companies, according to Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine: A. Russian nationals or natural or legal persons, entities or bodies established in Russia B. legal persons, entities or bodies, of which a unit as referred to in the present article litra a) directly or indirectly owns more than 50%, or C. natural or legal persons, entities or bodies, acting on behalf of or upon the instructions of a unit as referred to in the present article litra a) or b), Likewise, subcontractors or supporting units covered by the above cannot be used if this actor's contribution amounts to more than 10% of the contract value.
