Description

The subject of the contract is: 1) the production and delivery of 7 units of new, low-floor, electric-powered city buses (MAXI), with the following parameters: a) total length – from 11500 mm to 12500 mm; b) total width – up to 2550 mm without mirrors; c) total height – up to 3300 mm (including air conditioning installation); 2) the production and delivery of 6 units of new, low-floor, electric-powered city buses (MEGA), with the following parameters: a) total length – from 17500 mm to 18500 mm; b) total width – up to 2550 mm without mirrors; c) total height – up to 3300 mm (including air conditioning installation); 3) the delivery, installation, and commissioning of 13 units of new charging stations for electric buses, forming part of the electric bus charging system; 4) the delivery and commissioning of 1 unit of a new mobile charging station for electric buses, forming part of the electric bus charging system; 5) the delivery and commissioning of 1 unit of a new 0.5 MW emergency power generator for backup power, forming part of the electric bus charging system. A detailed description of the subject of the contract is provided in the draft contract with annexes and in the annexes to the description of the subject of the contract. The subject of the main contract is part of the Project entitled: „Zero-emission buses for sustainable mobility in Koszalin - Stage II" planned for co-financing from the EU budget under Action FENX.03.01 Urban Transport from the European Funds for Infrastructure, Climate, Environment 2021-2027, tender no. FENX.03.01-IP.02-001/25.II. See the content started in point 2.1.4 of this notice. 1.3) Certificates, as referred to in Section I point 6.1 subpoint 2.4 SWZ, certificates or other documents confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, as referred to in Section I point 6.1 subpoint 2.5 SWZ, or an extract or information from the National Court Register or from the Central Register and Information on Business Activity, as referred to in Section I point 6.1 subpoint 2.6 SWZ – submit a document or documents issued in the country where the Contractor has its registered office or place of residence, confirming respectively, that a) it has not breached obligations related to the payment of taxes, fees or social security or health insurance contributions, b) its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not concluded an agreement with creditors, its business activity is not suspended nor is it in a similar situation resulting from a similar procedure provided for in the provisions of the place of initiation of this procedure. 2) The document, as referred to in subpoint 1.1, should be issued no earlier than 6 months before its submission. Documents, as referred to in subpoints 1.2 and 1.3, should be issued no earlier than 3 months before their submission. 3) If in the country where the Contractor has its registered office or place of residence or the place of residence of the person to whom the document relates, the documents, as referred to in subpoint 1, are not issued, or if these documents do not relate to all the cases referred to in Article 108(1) points 1, 2 and 4 and Article 109(1) point 1 of the PZP Act, they are replaced respectively in whole or in part by a document containing respectively a declaration of the Contractor, indicating the person or persons authorised to represent it, or a declaration of the person to whom the document was to relate, submitted under oath, or, if in the country where the Contractor has its registered office or place of residence or the place of residence of the person to whom the document was to relate, there are no provisions on the declaration under oath, submitted before a court or administrative body, notary, professional or economic self-government body, competent in relation to the registered office or place of residence of the Contractor or the place of residence of the person to whom the document was to relate. The provision of subpoint 2 applies. III. 1) Only an entity authorised to act on behalf of the Contractor may submit an offer. 2) In order to confirm that the person acting on behalf of the Contractor is authorised to represent it, the Purchaser requires the Contractor to submit an extract or information from the National Court Register, the Central Register and Information on Business Activity or another relevant register. The Contractor is not obliged to submit documents, as referred to in the first sentence, if the Purchaser can obtain them through free and publicly available databases, provided that the Contractor indicates the data enabling access to these documents. 3) If a person acting on behalf of the Contractor, whose authorisation to represent it does not result from the documents, as referred to in subpoint 2, the Purchaser requires the Contractor to submit a Power of Attorney or other document confirming the authorisation to represent the Contractor. 4) The Power of Attorney to represent the Contractor specifying its scope should be submitted together with the offer. The Power of Attorney is submitted in electronic form and is signed with a qualified electronic signature of the person authorised to represent the Contractor. In the case where the Power of Attorney was drawn up as a paper document and signed by hand, a digital copy of this document signed with a qualified electronic signature, certifying the conformity of the digital copy with the paper document, is submitted. The conformity of the digital copy with the paper document, as referred to in the preceding sentence, is certified by the grantor or may also be certified by a notary.
