Description

The subject of the contract is the execution of construction and assembly works for the task: Reconstruction of the 110 kV line along with the reconstruction of GPZ Iława (Stage 1 and Stage 2), divided into Parts: 1.1. Part No. 1 (also referred to as Stage 1 in the project documentation): Reconstruction of the 110 kV line relation GPZ Iława – GPZ Iława Wschód, GPZ Iława Wschód – GPZ Lubawa, GPZ Lubawa – GPZ Ostróda to a double-circuit line and the expansion of GPZ Iława, 1.2. Part No. 2 (also referred to as Stage 2 in the project documentation): Reconstruction of the 110 kV line relation GPZ Ostróda – GPZ Ostróda Wschód, GPZ Ostróda Wschód – GPZ Gietrzwałd to a double-circuit line and the construction of a 110 kV cable line within the GPZ Ostróda area. 2. The scope of the works includes: 2.1. in the scope of Part No. 1 – reconstruction of the single-circuit overhead 110 kV line relation GPZ Iława – GPZ Iława Wschód, GPZ Iława Wschód – GPZ Lubawa, GPZ Lubawa – GPZ Ostróda to a double-circuit line with the construction and reconstruction of telecommunication infrastructure along the route of the designed and existing relations as well as the expansion of the existing 110 kV substation in GPZ Iława in the scope enabling the introduction of the second circuit of the 110 kV line, 2.2. in the scope of Part No. 2 - reconstruction of the single-circuit overhead 110 kV line relation GPZ Ostróda – GPZ Ostróda Wschód, GPZ Ostróda Wschód – GPZ Gietrzwałd to pole 71 (existing pole 99) to a double-circuit line with the construction and reconstruction of telecommunication infrastructure along the route of the designed and existing relations as well as the construction of a section of the 110 kV cable line within the GPZ Ostróda area. 2. The detailed description of the subject of the contract includes the project documentation and STWiORB, which is Annex 11A to SWZ (for Part No. 1) and Annex 11B to SWZ (for Part No. 2). The Purchaser requires that the subject of the contract be executed in accordance with the guidelines (Annex 15 to SWZ) and instructions as well as the standards (Annex 16 to SWZ) and the contractual provisions (Annex 13 to SWZ) indicated in this documentation. 3. The Purchaser requires that the execution of the subject of the contract be carried out exclusively using (irrespective of its method or scope) software, materials, products or devices that originate: 3.1. from Member States of the European Union or 3.2. from third countries which are parties to the Agreement on Government Procurement of the World Trade Organization or other international agreements, of which the European Union is a party, guaranteeing on the basis of reciprocity and equality of access to the public procurement market, whereby the determination of origin is made in accordance with Article 60(1) and (2) of Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code. The Purchaser requires that, in addition, the execution of the subject of the contract does not include:  any ICT product, ICT service or ICT process, which have been indicated in the recommendation of the Government Plenipotentiary for Cybersecurity, issued on the basis of Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating the negative impact of such ICT products, ICT services or ICT processes on the fundamental state security interest (Article 226(1)(17) of the Public Procurement Law) and  any ICT product, the type of which has been specified in the decision of the minister competent for informatization on the recognition of the supplier as a high-risk supplier, issued on the basis of Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or any ICT service or ICT process specified in such a decision (Article 226(1)(19) of the Public Procurement Law). The terms "ICT product", "ICT service" and "ICT process" shall be understood to mean, respectively, a product, service and process, as referred to in Article 2(12)–(14) of Regulation (EU) 2019/881 of the European Parliament and of the Council of 17 April 2019 on ENISA (the European Union Agency for Cybersecurity) and on cybersecurity certification in the field of information and communication technologies, and repealing Regulation (EU) No 526/2013 (the Cybersecurity Act), in the meaning of the Act of 5 July 2018 on the national cybersecurity system. 4. The Purchaser, taking into account that the completion of the contract in each of the Parts will take place after 01.01.2028, informs that it will not accept any devices using fluorinated greenhouse gases with a global warming potential of 1 or greater, as on the date of acceptance of the construction work it will not be able to put such a device into use in accordance with the content of Article 13(9)(a) and (c) of Regulation (EU) 2024/573 of the European Parliament and of the Council of 7 February 2024 on fluorinated greenhouse gases, amending Directive (EU) 2019/1937 and repealing Regulation (EU) No 517/2014 (https://eur-lex.europa.eu/eli/reg/2024/573/oj?locale=pl). 5. The Purchaser allows for the submission of partial offers. The Contractor may submit only one offer for any chosen Part or for two Parts of the contract. 6. The Contractor will provide the Purchaser with a guarantee on the terms described in Annex 13 to SWZ. 7. The contract is an element of the project entitled "Development of intelligent medium and high voltage power grids Energa-Operator S.A. O/Płock and O/Olsztyn to increase the potential for connecting RES", which is applying for co-financing from the European Infrastructure, Climate, Environment
