Description
The subject of the contract is the supply of workwear and protective clothing, work and protective footwear, footwear and gloves for uniforms, and personal protective equipment (PPE), the quantity, designation, type, and kind of which are specified in Annex 3 to these Tender Conditions (TC). The subject of the contract is divided into the following groups: Group I – Work and Protective Clothing Group II – Work Clothing for the In-house Rescue Service Group III – Work and Protective Footwear Group IV – Footwear and Gloves for Uniforms Group V – Personal Protective Equipment I Group VI – Personal Protective Equipment II Group VII – Personal Protective Equipment III Group VIII – High Visibility Protective Clothing Group IX – Work Clothing for the Infrastructure Maintenance Department Based on Annex 3 to the TC, Annex 1 to the contract will be determined. 2. The Contracting Authority allows for the submission of partial offers for individual complex groups. 3. The Contracting Authority does not allow for the submission of partial offers within a given group. 4. The Contracting Authority does not allow for the submission of variant offers. 5. The Contracting Authority does not envisage concluding a framework agreement or conducting an electronic auction. 6. The Contracting Authority allows for the possibility of entrusting the implementation of the subject of the contract to subcontractors. In such a case, the Contractor, in Annex 2 to the SWZ (Offer Form), will indicate the parts of the contract whose execution is intended to be entrusted to subcontractors and will provide the names of subcontractors if they are already known. The Contractor is responsible for the actions or omissions of subcontractors as for their own. 7. Samples must be delivered no later than on the tender day, i.e. by 28.09.2026 at 9:00 am to the MPK Clothing Warehouse in Poznań at ul. Forteczna 2, open from Monday to Friday from 7:00 am to 1:00 pm. (Note - The Contracting Authority has designated two different addresses for submitting samples and for submitting offers. The deadline and address for submitting offers are specified in Section 1 of Chapter XIII of the TC), 8. The subject matter evidence, which, in addition to the documents listed in Section 6 of Chapter XII of the SWZ, the Contractor submits together with the offer: 8.1. Technical documentation relating to the presented samples, in accordance with the description in Section 2 of Chapter III of the SWZ: - conformity documents (declarations), - documents issued by the fabric manufacturer, - documents confirming the parameters of the reflective tapes used, - abbreviated material descriptions, - user instructions, - maintenance instructions, - brochures, catalogs, leaflets or other materials with a photograph of the offered product and written information confirming the required properties and parameters regarding the assortment, in cases where the delivery of samples is not mandatory. 8.1.1 If the user instruction or maintenance instruction is permanently attached to the sample (e.g. in the form of a print on the packaging or label), a summary of such instructions with information on how they are placed should be attached. 8.1.2 The assortment from Group V, VI and VII should have a user and/or maintenance instruction in the form of a separate document (or a copy of the document) for a given batch of the product (i.e. not in the form of a print on the packaging), in order to verify the conditions of use of the product. 8.1.3 The attached documents should have the information about which assortment they relate to, i.e. the group number and the position number in the group. 8.2. Documents for the assortment from Group I – II: - a conformity document (declaration), issued on the basis of regulations concerning the assessment of conformity. This document should be valid for the duration of the delivery - applies to assortments which in col. 3 (“Required conformity document”) of the table contained in Annex 3 to the TC have the marking “YES”, The attached conformity documents should have the information about which assortment they relate to, i.e. the group number and the position number in the group. 8.3. Documents for the assortment from Group III – IX: - a conformity document (declaration), issued on the basis of regulations concerning the assessment of conformity. This document should be valid for the duration of the delivery - applies to assortments which in col. 3 (“Required conformity document”) of the table contained in Annex 3 to the TC have the marking “YES”, The attached conformity documents should have the information about which assortment they relate to, i.e. the group number and the position number in the group. 9. The Contracting Authority, in the procedure for awarding a public contract, uses the right to limit access to contracts for Contractors from third countries, with which the European Union is not linked by any international agreement guaranteeing, on the basis of reciprocity and equality, access to the market of public contracts. This limitation consists in not allowing participation in the procedure. 10. The Contracting Authority does not allow participation in the procedure for Contractors (as well as Contractors jointly applying for the contract, at least one of whom is) with a registered office (or place of residence) in countries other than a Member State of the European Union, a state of the European Economic Area, a state-party to the Government Procurement Agreement (GPA) concluded within the World Trade Organization or a state-party to an agreement concluded with the European Union regulating mutual access to public contracts. 11. The Contracting Authority, upon receiving an offer from a Contractor from outside the EU, will verify whether the offer is covered by agreements concluded by the EU regarding the award of public contracts in an international context, such as the GPA or free trade agreements, in order to determine whether the Contractor has obtained access to this procedure. 12. The Contracting Authority may cancel the procedure for awarding a contract appropriately before the deadline for submitting offers, if circumstances arise that make it unreasonable to continue the procedure, in accordance with Article 256 of the Pzp.
