Subject of the Contract. 1.1. As part of the implementation of the contract, the Contractor undertakes to sell, deliver, install, commission and test, for remuneration, two new factory-made two-channel ion chromatography sets enabling simultaneous analysis of anions and cations equipped with automatic sample filtration, hereinafter referred to as the "subject of the contract". 1.2. A detailed description of the subject of the contract is contained in Annex No. 1 to the specification. 1.3. As part of the implementation of the subject of the contract, the Contractor undertakes to: 1) deliver, install and commission the subject of the contract at the premises of the Purchaser, 2) carry out the installation of the subject of the contract on site in accordance with the guidelines of the Purchaser, and notify the Purchaser of the completion of all necessary installation works to the extent that enables the Purchaser to commission the equipment, 3) commission the subject of the contract after the Contractor has completed the necessary installation works, 4) conduct training in the operation of the equipment, software and maintenance of the subject of the contract at the premises of the Purchaser, as well as application training and implementation of methodologies confirmed by the issuance of a certificate, within the timeframe agreed with the Purchaser. 2. Delivery Conditions. 2.1. The Contractor is obliged to deliver, install and commission the subject of the contract within the timeframe agreed with the Purchaser, but no later than the time specified in Part VI of the specification. 2.2. In order to agree on the delivery date, the Contractor shall notify the Purchaser by telephone or email, no later than 14 days before the date specified in Part VI of the specification, of the readiness to implement the subject of the contract. 2.3. Place of delivery – Department of Leak Utilisation building E, Laboratory room of the Salt Mine "Wieliczka" S.A., 32-020 Wieliczka, Park Kingi 1. 2.4. Delivery hours are set on weekdays from Monday to Friday from 7:00 – 13:00. 2.5. The Contractor is obliged to deliver the subject of the contract at its own cost and expense. 2.6. The Contractor is obliged to install and commission the subject of the contract in the Laboratory room in building E. 2.7. With the delivery, the Contractor undertakes to deliver: 1) a warranty document, 2) a delivery note (WZ), 3) a Declaration of Conformity CE, 4) full technical documentation of the equipment in Polish, in paper form and on electronic media. 3. INFORMATION ON SUBJECT MATTER PROOF. 3.1. The Purchaser requires the submission of the following subject matter proof: - documents confirming the offered parameters to the extent that unambiguously confirms the fulfilment of the requirements mentioned in points 1.1.1., 1.1.2., 1.2.1., 1.2.2. of Annex No. 1 to the specification, e.g. catalogue cards and/or technical specifications. 3.2. The subject matter proof shall be prepared and submitted to the Purchaser in electronic form, qualified electronic signature or in the form of digital copies qualified electronic signature by an authorized entity, certifying the conformity of the digital copy with the paper document – in cases where the Regulation of the President of the Council of Ministers of 30 December 2020 on the manner of preparing and submitting information and technical requirements for electronic documents and means of electronic communication in the procedure for awarding a public contract allows the submission of a digital copy. 3.3. In the event of failure to submit the required subject matter proof referred to in point 1, or if the required subject matter proof is incomplete, the Purchaser will call for their supplementation within a period not shorter than 5 days from the date of the call for supplementation, unless, despite the submission of the subject matter proof, the offer is rejected or the grounds for invalidation of the procedure occur.
