Retendering after cancellation of previous tender: Framework agreement for maintenance of smoke and heat extraction systems (RWA) and locking systems

The execution of maintenance according to smoke and heat extraction systems (RWA) and locking systems (FestA) at Cologne/Bonn Airport is being tendered. The maintenance of the FestA is carried out on the following bases:

- DIN 14677,

- Guidelines for locking systems DIBt,

- Manufacturer specifications

The maintenance of the RWA systems is carried out on the following bases:

- DIN 18232-2,

- ASR 1.6/1.7,

- Manufacturer specifications

The cycle for inspection and maintenance work is planned to be 1x per year. In addition, services for the repair or renewal of systems can be procured via this framework agreement. The previous tender was cancelled because it became apparent during the ongoing implementation of the previous award procedure that the suitability criterion defined in the notice or the award documents – „Manufacturer training on the locking systems to be maintained at the airport“ and – „Manufacturer training on the RWA systems to be maintained at the airport“ was, in its concrete design, legally flawed and not sufficiently determined.

The design of this suitability criterion restricted the circle of potential bidders in an inadmissible manner and was in conflict with the principles of fair, non-discriminatory competition and the requirements of the SektVO for proportionate and substantively justified suitability requirements. Therefore, the continuation of the previous award procedure on the basis of this defective suitability requirement was not legally permissible.
