Poland – Pharmaceutical products – ZAKUP I DOSTAWY LEKÓW DO PROGRAMÓW LEKOWYCH, CYTOSTATYKÓW ORAZ LEKÓW STOSOWANYCH W RAMACH PROCEDURY RDTL

The subject of the contract is the successful purchase and delivery of medicines for pharmaceutical programs, cytostatics, and medicines used in the RDTL procedure for the needs of the Contracting Authority. The detailed description of the subject of the contract and the estimated quantities are included in Annex No. 5 to the SWZ (Price Form - Description of the Subject of the Contract) and in Annex No. 4 to the SWZ (Contract Draft) - The subject of the contract has been divided into 41 parts, in accordance with Annex No. 5 to the SWZ. Price Form - Description of the Subject of the Contract. - The Contracting Authority allows the submission of partial offers for any quantity of Packages listed in Annex No. 5 to the SWZ – Price Form - Description of the Subject of the Contract. However, the Contracting Authority reserves the right to submit offers by the Contractor for the entire assortment in a given Package. - The offered medicinal products must have current marketing authorisations valid on the date of submission of the offer issued by the Minister of Health or a marketing authorisation issued by the Council of the European Union or the European Commission in accordance with the Act of 6 September 2001 on Pharmaceutical Law (Dz.U.2025.750 t.j. as amended). - Medicines used in pharmaceutical programs or chemotherapy must be included in the Catalogue of Reimbursed Medicines, must have registered indications for use in the given medical procedure, and must be defined in the description of the pharmaceutical program or in the list of chemotherapy. - Medicines in RDTL must have registered indications for use in the given medical procedure. - The Contracting Authority requires the name of the commercial product, the manufacturer and the EAN code of the medicinal products to be provided for the offered product. - The Contracting Authority allows a change in quantity from pieces to packages with the appropriate price recalculation. The Contracting Authority agrees to a change in the size of the packaging with the reservation of not exceeding twice the size of the packaging for oral forms such as tablets, syrups, etc., unless otherwise agreed for the indicated individual position. In cases where a single package containing a different quantity (different weight) than the quantity specified in the SWZ is offered, the quantity must be recalculated to two decimal places according to arithmetic rounding. - The Contracting Authority allows the submission of offers that are pharmacologically and therapeutically equivalent, the criterion according to which the Contracting Authority will assess equivalence:
