Section 130a, paragraph 8, of the German Social Code (SGB V) allows health insurance funds and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the German Act Against Restraints of Competition (GWB) is carried out by DAK-Gesundheit. For the medicines to be specified by the bidder in more detail in Annex 2 to the contract, for the aforementioned active substance Oxybutynin (exclusively in the dosage form PFT), ATC G04BD04, DAK-Gesundheit intends to conclude discount contracts for medicines with as many interested pharmaceutical companies as possible until new medicines discount contracts come into force. A discount contract under the authorisation model for the aforementioned active substance comes into force for the first time on 01.09.2026 and ends on 31.08.2028 (plus extension option 1x12 months). It ends automatically with the entry into force of the exclusive contract, regardless.
