Description

The subject of the contract is the award of a framework agreement for the supply of service vehicles for the needs of the Mazowieckie Police garrison. 2. The purpose of the framework agreement is to establish the conditions regarding orders that may be placed during the period of validity of the framework agreement, in particular prices, expected quantities, delivery times and warranty conditions. 3. The purchaser envisages the award of a framework agreement with a maximum of five contractors within the task. 4. In the event that more than five offers that cannot be rejected are submitted by contractors who are not excluded, the purchaser will rank the offers based on the offer evaluation criteria and conclude an agreement with the five contractors who obtained the highest number of points. 5. If several contractors receive the same number of points within the offer evaluation criteria, the purchaser will select the offers according to the rules specified in Section XXII, point 3-5 of the SWZ. 6. In the event that offers that cannot be rejected are submitted by five or fewer contractors who are not excluded, the purchaser will conclude a framework agreement with all contractors. 7. None of the provisions of the framework agreement may be treated as a commitment by the purchaser to place orders. 8. The non-placement of orders or the placement of orders for a lower amount may not be the basis for any claims by the contractor against the purchaser, including on the grounds of non-compliance with the framework agreement. 9. During the period of validity of the framework agreement, the purchaser will place orders with contractors on the terms specified in the framework agreement. Detailed provisions regarding the implementation of the execution procedures are included in Section XXVII of the SWZ. 10. The subject of the order is divided into 3 tasks: 1) Task No. 1 – Purchase and delivery of service vehicles of the SUV type – max 40 units 2) Task No. 2 – Purchase and delivery of service vehicles of the SUV type in an unmarked police version – max 20 units 3) Task No. 3 – Purchase and delivery of service vehicles of the SUV type in a marked police version – max 20 units 11. The purchaser does not limit the number of parts for which the contractor may submit an offer. 12. The purchaser requires that the delivered vehicles be made in accordance with: a) the TECHNICAL SPECIFICATIONS specified for each task, which are Annexes No. 1.1 – 1.3 to the SWZ, respectively for tasks No. 1 to No. 3, b) the principles of technical knowledge, generally applicable in this field, norms and standards, taking into account the applicable regulations, c) have the required certificates and homologations in terms of usability. 13. The contractor ensures that the delivered vehicles will be free from defects and will meet the conditions referred to in the Act of 20 June 1997 on Road Traffic and the regulations issued on the basis thereof, as well as other generally applicable regulations. 14. The purchaser requires that the contractor provide a warranty for the delivered vehicles as specified in the TECHNICAL SPECIFICATION for the given task with the proviso that the purchaser requires that the subject of the order be covered by a warranty for the mechanical, electrical and electronic components of the vehicle for a period of at least 36 months with a limit of 120,000 km of mileage. 15. The purchaser requires that the offered vehicle be brand new, of the I category, unused, unregistered. In the case of deliveries with a delivery date in 2026, the purchaser allows the delivery of vehicles produced in 2025 and 2026. In the case of deliveries with a delivery date in 2027, the purchaser allows the delivery of vehicles produced in 2026 and 2027. In the case of deliveries with a delivery date in 2028, the purchaser allows the delivery of vehicles produced in 2027 and 2028. In the case specified in § 2 para. 3 of the framework agreement, the purchaser allows the delivery of vehicles produced in the year of delivery or produced in the year preceding the year of delivery. 16. The purchaser agrees to the change of the delivered vehicle to one other than that offered in the offer form in cases where the contractor proves that the offered vehicle has been withdrawn from sale or its production has been discontinued, the purchaser allows the possibility of offering and delivering another vehicle provided that its technical parameters are not worse than those of the vehicle offered, and the price is not higher than that offered in the offer form, taking into account any valuation or change in the contractor's remuneration in accordance with § 8 and § 9 of this agreement. a) In the case referred to in para. 2, the contractor must obtain the purchaser's consent to change the offered vehicle. b) The purchaser has the right not to give consent to change the offered assortment if the contractor does not prove that the offered vehicle has been withdrawn from sale or its production has been discontinued or its technical parameters are not worse than those of the vehicle offered. In this case, the contractor will be obliged to deliver the offered vehicle in accordance with the content of Annex No. 1 to the framework agreement. c) The purchaser will communicate his consent or lack thereof, together with the justification referred to in point a) or point b), in writing to the contractor. 17. Place of delivery/receipt of the subject of the order: Provincial Police Headquarters with its seat in Radom, ul. 11-go Listopada 37/59, 26-600 Radom 18. On the day of delivery of the subject of the order, the contractor will provide the purchaser with complete documentation in Polish as indicated in the TECHNICAL SPECIFICATION for the given task. 19. Vehicles prepared for acceptance must have the initial inspections carried out by the contractor and at his expense, which will be noted in the vehicle's warranty book. 20. Acceptance of the vehicles will be confirmed by an acceptance protocol in accordance with the template constituting Annex No. 2 to the execution agreement, signed by the authorised representatives of the purchaser and the contractor.
