Poland – Surgical instruments – „DOSTAWA NARZĘDZI DO ZABIEGÓW MEDYCZNYCH I CHIRURGICZNYCH DLA COPERNICUS PL SP. Z O.O.”

1. The subject of the order is the delivery of medical and surgical procedure instruments for Copernicus PL Sp. z o.o. 2. The subject of the order has been divided into 44 parts. 3. The subject name according to the Common Procurement Vocabulary: 33169000-2 Surgical instruments. 4. The detailed description of the subject of the order specifying the requirements of the Purchaser, quantities, is contained in Annex No. 1 to SWZ – Product and Price List and in Annex No. 5 to SWZ – Contract Draft. The Contractor, by completing the positions indicated in Annex No. 1 to SWZ, confirms compliance with the requirements specified by the Purchaser. 5. The offered subject of the order must be approved for sale and use in accordance with the applicable legal provisions. 6. The offered subject of the order must be complete, of a high standard in terms of both quality and functionality, and free from material, construction and legal defects. 7. The subject of the order must be in accordance with the Act of 7 April 2022 on medical devices (Journal of Laws 2022 item 974 as amended) – if applicable. 8. In all records of the SWZ and its annexes, where the Purchaser refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or devices), in accordance with Article 99(5) and Article 101(4) of the Pzp Act, the Purchaser allows equivalent solutions. 9. The term "equivalence" of the solution, in particular, means: indicating that the offered solution has at least the same or better – described by a given norm, type or mark – technical and functional quality features that relate to the useful values of the subject of the order, appropriate for the applied material, component, product such as: functionality, performance, durability, service life, resistance, ease of use, safety, comfort of use, finish standard and features that describe the physical properties of the subject of the order, such as size (length, width, height), volume, density, shape, color, structure, type of material and component. The Contractor who refers to equivalent solutions is obliged to prove that the supplies, services or construction works offered by him meet the requirements specified by the Purchaser. 10. The Purchaser does not reserve the possibility of tendering exclusively by Contractors, as referred to in Article 94 of the Pzp Act. 11. The Purchaser does not set requirements, as referred to in Article 96 of the Pzp Act. 12. In connection with the implementation of the order, the Purchaser does not envisage the obligation to personally perform key tasks of the order.
