A sectoral dialogue and market survey have shown that currently, there is no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the contracting authority's area in accordance with the goals of the Gigabit Framework Regulation 2.0, and it will not be available in the next few years. Therefore, the contracting authority has applied for funding for a comprehensive gigabit rollout in the viability gap funding model under the directive "Promotion to support the gigabit rollout of telecommunications networks in the Federal Republic of Germany - Federal Gigabit Directive 2.0 (Gigabit-RL 2.0)" dated 31 March 2023, as amended on 30 April 2024 ("Gigabit Directive 2.0") and has received the notice of the final amount of the grant. The funds provided in this funding programme in the viability gap funding model (hereinafter: funds) are to be passed on by the contracting authorities to telecommunications companies in the sense of EU state aid law as investment cost subsidies for the construction and operation of gigabit networks.
